Beneficiary's passport needs to be renewed after I 130 pettition submitted. Will this be a problem?

When I filed an I-130 petition for my husband, he didn't even have a Brazilian passport, so I left that section blank, and the petition was approved with no issues or delays.  He did need a passport at the NVC and visa interview stages of the process.  There is plenty of time for renewal of the current passport given all the delays in the process, because of COVID.  Good luck!

Then another read would have been warranted because you are overlooking an IF the passport was used to enter the USA then fill out the information.

That won’t be a problem… that happened to me, when i got my new passport I called the Embassy and they updated it on my profile. That’s it

It's a mistake many people make.

 

That part, or just before, states if the beneficiary is currently in the US you need to enter the I-94 information (when he/she entered) and the passport number. I almost entered my wife's passport information until I read it a 3rd time.

 

Regardless, it does not matter if the beneficiary needs to renew their passport.  It happens often due to the long processing times of these visas.  Ask your husband to renew it as soon as possible.  You will need it during the NVC stage when the bio page(s) need to be uploaded and for the DS-260.

Only if you read the i130 instructions once, Page 5- last paragraph of item 7.

I renewed my home passport in the middle of my I130 process, I took both of them (old and new) to my I485 interview, no questions was asked, the officer asked for my passport, I gave him my new one and he checked my name/date of birth/ and nationality, but not the number, good luck!

There is no requirement for the passport listed on the I-130 to be the one brought to the visa interview.  It is ok to renew the passport after submitting the I-130.  The instructions even say that it is ok to put an expired passport number in that field.  Just list the new passport number on the DS-260 visa application form after the I-130 has been approved.

 

Here is what the actual I-130 instructions say -- "Passport and Travel Document Numbers. Complete Part 4., Item Numbers 45. - 50., as applicable, if the beneficiary relative used a passport or travel document to travel to the United States, enter either the passport or travel document information in the appropriate space on the petition, even if the passport or travel document is currently expired.https://www.uscis.gov/sites/default/files/document/forms/i-130instr.pdf
