i feel like im missing out a lot of memories back home. i left my wife and my 2 very young kids. i am struggling, homesick and despressed already. i live with my family here but my "own" family is all i think about. im tryin to be strong but sometimes i really wanna quit. i dont know wat to do.

im an immigrant and i wonder if i go back to manila and stay there 2 to 3 years is that acceptable at all? i mean would you do that or rather sacrifice now than to wait longer again if you go back. can i still go back? what would they need from me if i request to go back after 2-3 years? thanks

We don't have enough information on your situation to tell you what would happen immigration wise if you left for two years.

For example, what visa type did you come here on? Have you filed for AOS, or do you already have your 2 year green card?

well, if I did a little digging through his posts and found out what is going on...

i arrived in US last year and next christmas will be the first time i will be going out of the US...and i am planning to have a 90 days vacation in the Philippines

Now my friend told me that if i would apply for US Citizenship 5 years from now she said USCIS will deduct all the days that im out of the country from the total of days I should be inside USA to be eligible for citizenship.

i have 2 kids in the philippines and wish to spend longer time with them but now that i heard that news i feel limited of my time to visit philippines

is it true? 5 years minus 90 days meaning im still not eligible if time comes...

http://www.visajourney.com/forums/index.ph...mp;#entry964554

i have a gf in the philippines and we have 2 kids but we are not married

i am a legal permanent resident (LPR) since august 2006

i need some advice whether i go back and marry her and petition them

or wait for my Citizenship by 2011 and petition her as my fiance (k1)?

Which one is faster?

I haven't heard of a lifetime greencard but maybe I just haven't read anything on it. The most I have seen is a 10-year card. You can go back to the RP on a green card but need to remember that if you stay longer than 365 days you will need to apply for a re-entry document before you leave.

I am not sure if there is such a thing as a lifetime LPR green card.... I thought green cards were only good for up to 10 years and then you have to renew again or something.....

only thing that would be considered lifetime would be getting a US citizenship....

I think the lifetime green card is just that...it is the status that is the lifetime (providing you dont stay away longer than you are supposed to). The card needs to be renewed every 10 years but if you have kept the residency requirements then I believe it would be a lifetime card.

I am sorry that you are having to miss your children so badly. As far as leaving for 3 years, trust ME, don't do it! I was a LPR since 1983 and left Texas in Dec. 2002. My GC would have become invalid as soon as I hit that POE and had to go thru immigration.

Is there a way that you can apply for her to get a K-1 visa and bring your kids over here too?

I was told that it is a life-time green card. Of course it has to be renewed every 10 years but you are able to remain a LPR for a life-time unless of course you do something so horrible which would call for deportation. I had my old GC which BTW, I had to surrender when we filed for the K-1, from 83-97 without renewing it. I had no clue I had to even renew it. I was 7 when I got my card and my mom always told me it doesn't expire. Since it was one of the old green cards, I don't believe it had an exp date on it either. When I went to Germany for a brief period and came back, the immigration officer asked why I had not renewed it. I told her i didn't know I had to. She told me that once I turned 14, I should have gotten a new one with a newer picture, as well as my fingerprint put on it. She clipped the corner of my card so I could not use it again. I then went for the renewal.

A reentry permit is needed for reentry for trips greater than one year but less than two years in duration.

http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

A re-entry permit can help prevent two types of problems:

(1) Your Permanent Resident Card becoming technically invalid for re-entry into the United States (U.S.), if you are absent from the U.S. for 1 year or more.

(2) Your U.S. permanent residence being considered as abandoned for absences shorter than 1 year, if you take up residence in another country. A re-entry permit establishes a presumption that you did not abandon status, and it allows you to apply for admission to the U.S. after traveling abroad for up to 2 years, without having to obtain a

returning resident visa. Re-entry permits are normally valid for 2

years from the date of issuance.

http://www.uscis.gov/files/article/B5.pdf

How do I get a re-entry permit?

If you want to get a re-entry permit, file Form I-131, Application for Travel Document. You should file this application well in advance of your planned trip. The I-131 is available on our website at uscis.gov.

The instructions on the form will give you more details. If you have questions after you read the instructions, just check our website or call customer service at 1-800-375-5283.

well i just said its a lifetime just to make things short..but i didnt mean literally lifetime.come on! :-)

anyway the thing is im a green card holder thats it..my question is is it ok if i go back there and stay 3 years? i know i should get a license something in order to go back here if i know ill be away more than 365 days. but anyway i think u already helped me. so im thinking ill just sacrifice and stay here. then wait till i petition them if i become a citizen in 2011.

No, it's not ok. If you stay too long outside US you can loose your Permanent Resident status, even if you apply for a re-entry permit, 2 or 3 years out of US would mean (to the government) that you no longer want to live in US, so you don't need a GC anymore.
