Owning House in US before Marriage

Hello,

 

I’m from the U.K. and my partner is a US citizen. Our plan was to marry and then buy a house once my spousal visa was in place. However covid has prevented us from getting married and my partner has now found a house we would like to buy. The plan is the mortgage will be in my partners name but the title will be in both our names (50/50 ownership). I will pay my share to my partner while I continue to work in the UK. Once we get married will this have any implications on the spousal visa process or cause any issues when I visit the US, once borders open again?

Many places the mortgage document holder must match the deed ownership.   You need to verify if your plan is even doable from a legal perspective

Thanks for your replies,  the mortgage provider has confirmed they are happy for my name to be on the the title and not the mortgage.

It’s seems it might be quite difficult to be added to the title at this stage. Do you think there would be any issue with me sending money to my partner to help with the down payment and mortgage payments and then be added to the title later when we are married? Is sending large sums of money (~$20000) seen as a negative? We would be splitting everything 50/50.

@ert1569, with all due respect - I hope that you weigh all your options and carefully consider the advice both solicited and unsolicited that people are giving you here. 

I would personally take one step at a time and focus on the spousal visa first. You are in for a long wait. Everything is taking longer these days with COVID. 

 

I-751 Joint Filing.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.
