Seems like K3's are quicker and the I-130 is included anyway if the K3 has a problem.

Need advice before August... PUHLEEZ! :thumbs:

2-2-07 Sent I-129F to NSC

2-6-07 NSC received USPS mail, NSC then to CSC

2-15-07 NOA1 -file received

2-16-07 check cashed

2-23-07 touched

5-4-07 NOA2 approval -email

5-13-07 sent cancellation request letter

6-7-07 we're going to retry with a K-3

8-6-07 married in Thailand (dual language, dual representation prenuptial)

8-7-07 sent K3 from Bangkok

9-10-07 I-130 NOA1, (received at CSC 8-9-07)

10-9-07 sent I-129F to CSC

11-1-07 touched I-130

requested consular processing I-130 (http://www.uscis.gov/files/pressrelease/PN_i-129f.pdf)

9-13-07 I-129F for Spouse arrived CSC via USPS return rcpt. requested

4-1-08 NOA2 for K3 (I-134 supposed to be processed but processed I-129F instead)

7-11-08 interview Bangkok, passed.

7-16-08 POE arrival, 2 hours in Seattle Customs.

AOS I-486 sent 4-4-09

AOS NOA1 4-13-09 for all; I-485, I-131, I765

RFE 4-27-09 Thai official document in lieu of original Birth Certificate not sufficient???

Infopass appointment 5-26-09 at USCIS. Officer thought our doc was valid and doesn't know why the RFE.

7-28-09 EAD and AP sent

Social Security card 8-4-09

interview 9-10-09

10 year green card expires 9-17-19, Permanent Resident Card.

Resident since 9-10-09.

Cost! K-3 has the added cost of filing I-129F, and after July 30 if you plan on adjusting in the USA, $1010 for AOS, or having to fly back to the foreign country to interview for the CR-1 visa.

Alos lately when a person starts a K-3 by filing I-129F, USCIS holds the approved I-130 and is not sending it to NVC assuming that the K-3 will do AOS, saving NVC, and the consulate from wasting time doing paperwork only to have the K-3 do AOS. In order to keep I-130 moving through NVC, a petitioner is needed to file I-824 and pay an extra $200

If you can deal with the couple extra months apart, go CR-1, it results in a green-card shortly after entry into the USA, this enables work and travel, and costs much less. K-3's need to apply for EAD or wait for AOS to complete, which can me months or years. EAD takes up to 90 days to get, all the time the K-3 cannot work.

The other thing is hassle to go through AOS process after entering U.S.

CR1 holder will be done when he/she comes to U.S.

Immigration officer at Port of Entry (Airports , entry point from ground or harbor) will stamp passport with temporary I-551 stamp with 1 year validity.

Then US CIS will send plastic permanent resident card within 1~2 months.

He/she can work right away after receiving I-551 temp stamp in theory, but after receiving official I-551 plastic card in reality in most case.

But K3 visa holder needs to follow additional process to go through Adjustment of Status (I-485) and interview process after getting into U.S.

This will take a couple of months easily.

In the meantime, he/she can not start to work unless getting EAD approval.

So K3 will bring both together a little bit earlier, but it will take more time to receive actual I-551 Green card.

CR1 will take additional one or two months comparing to K3, but the process will be much simpler.

Thanks folks! PRAISE applied. That's what I understood. But I didn't know about paying $200 to keep the I-130 going through.

$1010 + $200 would not be a problem to be together sooner.

She doesn't care if she works or not, and neither do I.

The hassle getting the AOS after entry is a bad thing, but I'll have her next to me as I sit here at the puter. Actually she'll be playing with my kid like as not.

No guarens K3s will get AOS approval either. Some peeps are still waiting after 8 months and longer.

No SSN can be a pain also. Not just because they can't work. No drivers license[depending on the state]. No insurance, No school, No joint accounts etc. Exceptability varies in different places but sure didn't in our case. K3!

K3 suck compared to CRs or IRs!!!

K3 suck compared to CRs or IRs!!!

Lawyers LOVE the K-3, they can charge extra to file the I-129F, and they hope for more fees to file the AOS for their clients, this is why lawyers always push the K-3 over the CR-1 visa.

I know you have your act together . Do you have the USCIS or link showing this? I've seen it mentioned often and realize it's a fairly recent thing but I haven't been able to find it!

NVC informed me they were sending my I-130 petition back to CSC when I informed them I was going with the I-129F.

Weird tho as I recently applied to CSC to get some originals back and just got a letter back saying to apply to NVC!

No biggy tho as I'm just giving it a shot and the application is free.

We filed an I 824 to have my I 130 sent to the NVC- in my case- I left the US when I wasn't supposed to and had to go through the Visa process in Canada. We filed the I 824 in November, paid the $200. It just got approved a week ago. 9 months. It was knowing that the I 824 was at least a 6 month waiting time is what made us file for a K3.

I am back in the US now with a K3- my K3 took 5 months start to finish. The K3 path was worth it for us. Yes I have to go through EAD and AOS, but I am here with my husband and it is worth it.

That's the way I'm thinking. I need to save money as a single Dad and am not a paperwork guy. But we all need to be together, as a family. Priceless, like the ad says.

From times on this board I'm seeing 329 days for a CR1, and 187 for a K3. That's 142 days less. Could that be right?

For someone who feels the extra cost wouldn't be too hard to swallow and for a foreign spouse who isn't concerned about working right away, you will probably find the K3 better for your situation. As you said, AOS will be a hassle, but as lease she be with you while she does it.

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)
