Help: Travel to US for funeral while I-130 pending

My wife petitioned i130 for me last year and we are still waiting for the approval. Last Friday i had a bad news from my wife that my mother in-law is dead. I need to attend the funeral too. Will it be possible for my wife to send me an invitation to attend the funeral? Please help.

She can invite you, but you would still need a valid entry document to enter the US such as a valid visa, etc.  Where are you right now?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Sorry for your loss.  You can attempt to get an emergency B2 visa appointment.    You can expect to need your mil’s death certificate, your marriage certificate, and her birth certificate.  The issue of your pending I-130 will come up.  The concern the consulate will have is whether you will attempt to adjust status once inside the USA.  Even if you get the visa, be prepared for CBP at the border to deny entry.  
 

It is cruel but unfortunately, Congress did not draft the immigration laws for this situation.

There are people who passed away from Covid last year who still haven’t been buried.  
 

While there might be some cultures snd religions in the USA that bury after 3 days, not all do.  
 

And many if not most deceased in the USA are cremated.  Burial if it happens at all, can happen decades later.  

 

and if they have funeral decades later,    he doesn't need visa now

I am sincerely sorry for your loss.  I think there is very little chance of obtaining a B2 visa.  Current US law and and other factors would make it difficult.....but you can apply if you wish.

Your US spouse can submit an expedite request based on extreme hardship, but it will still take months to complete the process.  No, your contacting USCIS would not be of much value at this point.

Funeral and burial are different things.  I realize I myself am an immigrant but I’ve been here 41 years and was born and raised in Canada with similar cultures to the USA.   
 

Your comments are perplexing. We live in decidedly different America’s.

They will not speed up the process unless your spouse submits an expedite request.....and there are no guarantees since expedite requests are extremely common now.
