Case FE review note-W2/1099 form

I got case FE review note said

”please submit every 2020 W-2/1099 form”. But I do not have these as I only have oversea income. Another note said, I do not meet the minimum income requirement to sponsor the intending immigrants. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted” 

so, I still need to submit w-2/1099 form? Or just submit I864 from joint sponsor?

You can't submit what you don't have.

Write a letter explaining what your overseas income was, attach any evidence of such, and state that you had no US-based income.  Also explain if you filed a US income tax return for 2020 or not.  If you didn't, explain in your letter why you were not required to (below the minimum threshold).  Keep in mind that US citizens are required to file income tax returns with the IRS based on their total worldwide income.  You'll need a joint sponsor to complete a I-864 with supporting financial documents, to include with your response to the RFE.  Good luck!

Thanks for your advice. Actually I did filed 2020 tax return for my foreign income and rental income(US house). Yes, I will have joint sponsor. Hope every document will be completed soon, and my husband will not wait too long for interview.

unless the overseas income will continue when you live in the US ,,  it won't count

but you can provide them with copy of the IRS compete transcripts in lieu of a W2

you will need joint sponsor

Still, as the primary sponsor, you need to submit all forms and supporting evidence.
