So, I've managed to understand all of the governmental mumbo-jumbo ####### up until this point, which I think is good on me.. But the I-134 is a little more complicated and something I really don't want to mess up because I feel it's our last real hurdle between getting my visa and ever-lasting marital bliss. (I'm not really worried about the interview.. now. Hehe, I bet I'll be nervous when it comes, though.)

Anyway, I know you need these things from your sponsor for the I-134:

* I-134 signed and notarized.

* Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS

* Photo copy of IRS form 1040, and W2s for past 3 years

* Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

* Photo copies of past 6 months pay stubs up to a few weeks before the interview.

Okay, so... he hasn't had a job since 2002, but he's getting one now (he'll have it by the time I need all this stuff for my interview, so that's no stress). The question I wanted to ask is, since he hasn't had a job for the last 5 years, clearly there's no tax transcripts since he hasn't paid tax. And he won't have had his new job for at least 6 months before my interview so will whatever pay stubs he's earnt thus far (up until before the interview) suffice? And will not submitting tax transcripts due to him not having a taxable income hurt us? I'd hope not since either way, he doesn't have anything to submit.

He'll be on 20k a year and the 125% poverty line is 17k so hopefully that means we don't need a co-sponsor, correct?

I'm sure you've been asked these questions before but I'm really nervous and I just want to get it right. It's a year we've been apart now and I'd hate to have to try all over again if we fail.

One thing I like to point out, if you feel that financials are not favorable for the K-Visa interview, you can always enlist a co-sponsor that has better financials, then later when adjusting status and your US Citizen spouse/sponsor's financials are a bit better, then go solo sponsor for AOS.

He qualifies. He's going to have to explain why there are no tax returns. You don't mention how that came to be. If a student with no income, no problem. If living off tax free municipal bond interest, no problem. If in prison... You get the picture. Pay stubs for six months is really ridiculous. A couple recent ones to go along with the employer letter will verify current income. Current income is the most important factor.

I'd stop stressing over the financial aspect and concentrate on the total picture you'll be presenting.

I know about the co-sponor deal - but since his annual income is over the 125% poverty guideline I thought he was fine. Besides, the only person we could have as the co-sponsor is his father and that'd be harder than pulling teeth out with your toes, so I'd really rather not go down that road unless it's 100% necessary, and if he makes 20k and the guideline is 17k.. isn't that alright? No need for a co-sponsor?

And his reason for not having a job isn't nearly as glamorous as prison :P He just dropped out of school, got a job, the company went bankrupt and he hasn't done anything since - just lived at home. So me explaining this at the interview should suffice, yeah?

I am typing this directly from the Instructions of the I-134 that was sent from the Consulate in Sydney to my fiance (in his packet 3)....There are several sections to the instructions, but I think you just need the supporting evidence section....I hope it helps...

II. Supporting Evidence

As the sponsor, you must show you have sufficient income and/or financial resources to assure that the alien you are sponsoring will not become a public charge while in the United States.

Evidence should consist of copies of any or all of the following documentation listed below that are applicable to your situation.

Failure to provide evidence of sufficient income and/or financial resources may result in the denial of the alien's application for a visa or his or her removal from the United States.

The sponsor must submit in duplicate evidence on income and resources, as appropriate:

A. Statement from an officer of the bank or other financial institution where you have deposits, giving the following details regarding your account:

1. Date account opened;

2. Total amount deposited for the past year;

3. Present balance.

B. Statement of your employer on business stationary, showing:

1. Date and nature of employment;

2. Salary paid;

3. Whether the position is temporary or permanent.

C. If self-employed:

1. Copy of last income tax return filed; or

2. Report of commercial rating concern.

D. List containing serial numbers and denominations of bonds and name of record owner(s).

06-12-06 - Met with lawyer, filed for a K-1 visa

07-17-06 - NOA1

10-31-06 - Touched

01-29-07 - Found out from USCIS that my lawyer had filed at the wrong service center and nothing has been processed.

02-08-07 - Found out that our petition had been closed back in Oct. 2006. No one was ever notified of this from USCIS

02-09-07 - Began gathering paperwork once again to start all over. Started cancelling our wedding plans

02-20-07 - Filed for a K-1 visa once again

02-27-07 - NOA1

04-21-07 - Originally planned wedding date (had to cancel) :(

05-22-07 - Touched

06-01-07 - Granted a Congressional Inquiry!

06-15-07 - NVC received our approved I-129F petition (I never received an NOA2 via email or snail mail). We are just so HAPPY to finally move on!

06-25-07 - Packet 3 received (but it was rec'd by our lawyer, she has forwarded it on to my fiance in Australia)

06-28-07 - Fiance rec'd Packet 3

06-30-07 - Finally rec'd NOA2 via snail mail. It is dated June 25, same day as Packet 3 was rec'd.

07-05-07 - Mailed back form letter DSL-1076 (Applicant's Statement of Readiness to be Interviewed).

07-05-07 - Just waiting now in hopes of an interview date before APEC

07-13-07 - Received Packet 4

07-30-07 - Interview!!!! - APPROVED!

09-01-07 - Fiance arrives in the USA!

10-06-07 - Getting Married
