But I know of other cases where their partner is still incarcerated so I just don't get it. I totally get where you are coming from.

Are those cases here on VJ?  If so, can you provide a link?

I've spoken to the officiant in kansas and she says I can have the POA and the marriage licence is valid.

Also I'm on his visitor list. As I stated already.

I would live with his family. We've already discussed this.

Im not looking to file for a spousal visa right now. Im just trying to understand it all.

LOOK at the Kansas marriage site for proxy marriage / this is in  Kansas so he is the person that is in Kansas

you are the one not present in the state / you have to give him your POA so he can sign for u/  the site is very clear on this

It really makes no sense to do a proxy marriage in your case, since you cannot file until after you’ve been together in person.   What is the point, and how is it saving any time in the queue?

Well because we don't want to wait... God knows how long the restrictions would be.

I wonder how USCIS conducts joint ROC  interviews with an incarcerated spouse.

Yep.  This could be problematic.

Wait for what?   Your fiancé cannot file a spousal petition on your behalf until after you’ve been back to the US to see him ANYWAY.   Getting married by proxy vs getting married in person at the prison will make NO measurable different in your timeline.

This is why people are telling you that with a case which inherently already contains red flags (prison inmate), adding a proxy marriage to the mix may be an unnecessary risk with no real advantage.

The spousal petition is after you are married right?

Yes.   But he cannot file it after a proxy marriage UNTIL after you’ve been together in person.
