Hi Everyone! I have a social security number and card from 10 years ago when I was in the US on an F1 student visa. I recently moved back on a K1 and we just got married. We are now getting ready to file our AOS package. 
 

I have tried changing my name on my social security card but the offices are all closed and taking emergency appointments only. I am not considered an emergency. The only other way to change my name would be by mail but for that I’d have to mail in my passport which could take months. I cannot be without my passport for that long. 
 

Do any of you have any experience with requesting a new social security card on the I-765 application? If I filed that application in my new married name and checked the box requesting a new ss card, would SSA then go ahead and change my name and send me a new card in my new name?

 

I would greatly appreciate any advice on this.

On the I-765, did you mark item #13a as "Yes"? Did you enter your SS number in item #13b?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You'll get the SS card with the new name if you are filing AOS and i765 with the new name and check appropriate SS questions on i765.

Ok, Great. Thank you so much! I am so sorry for asking but are you certain that this is the case? I will definitely file the entire AOS package and I-765 in the new name then. 
 

I am just confused because other people say they had to take their EAD card to SSA in order to get their name changed after they received their EAD. You would think everyone would just check that box on the I-765

Am i certain? No because sometimes SS office and uscis lose communication in this matter because it's kinda a new thing. Should the SS card be issued under the name listed on I765? Yes. 
 

There are even cases where those checking the SS boxes on i765 never received their very first SS card and had to go to SS office to apply in person after getting EAD. The main point of that option in i765 is to get a new card or replacement card under the name on approved i765 without visiting the SS office.

Most people who submit an I-765 due to adjustment of status through marriage don't have an existing Social Security number. They mark the I-765 in order to receive an initial SS card.  The official I-765 instructions imply that, in your case, you will be issued an updated card .  Is it guaranteed?  No.

 

Ideally, when a person (who has never had a SS number) arrives in the US via a K-1, they apply for a SSN before marriage.

Thank you both so much! Your responses are very helpful. It’s reassuring to know that at least in theory it should be issued in the new name. 
 

I completely understand miscommunication between the agencies can happen and in that case I would make sure it gets changed after.
