US citizen already filed I130 for spouse

Thought it may be useful to add something here, as you've been given some bad information/opinions.

 

Biden has indeed put in place a travel ban, but as with all travel bans, spouses of US citizens are excluded.

 

Evidence from the proclomation - 

Sec. 2.  Scope of Suspension and Limitation on Entry. 

     (a)  Section 1 of this proclamation shall not apply to:

          (i)     any lawful permanent resident of the United States;

          (ii)    any noncitizen national of the United States;

          (iii)   any noncitizen who is the spouse of a U.S. citizen or lawful permanent resident;

 

You have also been told not to apply for a K3 visa as it is obsolete. The K3 visa does exist, and is offered as a measure to cut waiting time between I130 being submitted and the spouse being able to move to the US.

 

The K3 is indeed not often used, and it is only in extremely rare cases that they are accepted and processed.

 

BUT, what they have done in the past is force USCIS to look at your I130 petition, in order to clear the K3. For example, Potomac offer a 13-17 month response on I130's, but a 7.5-9.5 month response for the I129F (K3). SO, to clear the K3, they may close it and respond to the I130 within the 9.5 months.

 

It is honestly so important to do your own research on these matters, please research what I have said as well as what everyone else has offered.
