Hello, can you please tell me how you get an advance parole  and work permit after ASC has collected our biometric data?  Do they come in the mail?  Usually at the same time or separately?  What comes faster?  Our documents are processed by the National benefit Center.  They received our documents on April 2 (forms 485, 131, 765), NOA dated April 28, June 8 were on biometrics.

They arrive to you in the mail....usually as a combination card. But, it could take as long as 8 months.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

My son's studies in September begins at a university in Russia (he came with me on a K1 visa), can we request an expedited exit permit?  (can we use this financial reason, for example?https://www.uscis.gov/forms/filing-guidance/how-to-make-an-expedite-request ) If so, how fast is it done?

You can ask for a expedited AP.   I wouldn't expect to obtain it.

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

I have seen 5 months after Biometrics mentioned a few times. Bit of a guessing game.

If your son is starting university in Russia, then you chose the wrong path for him to immigrate. Remember that a GC is for someone to live in the US, not outside. 

 

An IO will most likely deny an AP expedite if the reason is to go back for studies.

Then he's most likely going to lose his green card since he will basically be immediately moving to a different country and this goes against the entire point of having a green card. It's free to request an expedite on anything with USCIS, but it sounds unlikely to be approved. This is more of a timing thing for you guys and USCIS will not consider that an emergency or financial hardship.

Look, he's going to live in the US after graduation.  He needs to unlearn 10 months of the 4 final undergraduate course - from September to June.  Transferring to another university is not an easy question from a financial, organizational, and emotional point of view, otherwise we would not cling to this option.  Can't he leave after receiving the advanced parole  and return for an interview for a green card? If 10 months is too long in another country, then what is the limit for staying in another country for an advanced parole?  He can take part of the studying in person in Russia and part of it remotely in USA, which requires agreements with the university. Perhaps, for example, go to Russia for three months, then come here to the United States for several months, studying at this time distantly and then go to Russia to pass exams and defend a thesis.  After all, an exit permit was requested for several entries and exits, and we described the situation as it is in the cover letter to Form 131.

I am a firm believer in applying for expedites, you just never know which ones they will approve.

 

AP has no time limit, obviously need to be back for Biometrics and interview.
