Am I allowed to travel to the US after being DQ'd?

Hi everyone. I was wondering if traveling to the US for a short vacation is allowed once DQ'd? I would be traveling from Toronto to SF for a few weeks. We are DQ'd and are supposed to be interviewing at Montreal under the F3 category. 

 

If I do this, will I need to also update DS-260 to reflect my new travel history?

Not a problem.  Just update at the interview.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The member that asked the question is Canadian so no B2 needed. If not a Canadian and their country of birth needs a B2 then yes it will be needed.

I got DQ'd at end of April 2021 for CR1. i am from Toronto too and I have been visiting my wife in South Florida since Early May and i am leaving this weekend. I had no issues at the border. Although have to do the whole taxi across the border method to avoid hotel quarantine.

 

But should we be updating our DS 260 if we travel to US post-DQ? Is updating it even possible since we have already submitted it?

Nice, that's good to know. I think Canada is lifting the hotel quarantine rule next month, still waiting for an official statement. 

 

For DS-260, I don't think you can update it online but I believe others in the comments section suggested to bring an updated version of it to the interview. Good luck!

You can update it during your interview.

Timeline

You have to make sure you bring ties showing “substantial ties” to Canada. Lease agreement/mortgage and a letter of employment are usually the most compelling.

 

Family is included in non-essential travel and lots of Canadians waiting their visas have been denied by CBP by land and by air. Mostly by land though. There’s a person with a Sept 2020 DQ that literally dropped their kid off at their parents across the border and was denied entry back to her home. I’m too scared to try right now because I’ll be stranded if I get rejected. 
 

If they suspect that you are trying to avoid the immigration process, wait out the process in the USA, or file an AoS, they will absolutely not let you in.

Thanks for the heads up. I'll need to do some research before booking my tickets then. 

 

If I'm understanding this correctly, does this mean Canadian travelers are denied entry into the US (when traveling there) or denied entry to Canada (when returning home)? 

 

I'm also a student, so I live with my parents. Not sure how I will prove my ties. I have a summer internship with a Canadian bank right now but I'm planning on traveling after my internship ends.

I’m spousal class so I think it may be different for you as F3- but they are really hard on spouses and fiancés right now. If you’re a student and can prove you’re returning to school in Canada that should be enough. They just want something that says you’re going to go back with high probability. So school works I think!
