Yes, VAWA AOS is under INA 245

Yes, VAWA AOS is under INA 245

thats great news, I am still waiting for renewal. I dont when they going to send it

I think the title is a bit misleading since INA 245 covers almost every adjustment application made including but not limited to IR, K-visa based, VAWA, F1 - F4, EB1 - EB5 (including SIJ under EB4), DV lottery, and S/T/U visa based. Pretty much anyone that files an I-765 under category code C09.

 

Pretty much the only adjustment applications left out of this are:

  • Registry (INA 249) (C16)
  • Cancellation of removal (INA 240A(b)) (C10)
  • Asylees/Refugees (INA 209) (A03 or A05)
  • NACARA Applicants (NACARA 203) (C10)

Replacement EADs will not be affected by this update; USCIS will continue to issue replacement EADs with the same validity dates as the original EAD.

 

This guidance, contained in Volume 10 of the Policy Manual, is effective immediately. The guidance contained in the Policy Manual is controlling and supersedes any related prior guidance.

Updates the validity period for initial and renewal EADs issued to applicants for adjustment of status under INA 245 from 1 year to 2 years.

We have yet to receive the EAD (QOS submission 2/21) and keep getting VJ updates that the timeline is moving forward instead of getting closer!  It was October-November, but recenpushed to January!

 

If they issue it that far away, it should be the 2 year, correct?

Timeline

Does anyone know how long it takes to get the EAD renewal approval nowdays? We applied for my husband's combo card renewal in May and did receive the receipt notice (which I understand extends his employment authorization by 6months) but trying to understand timeline estimate to get the renewed combo card. The receipt number starts with IOE which I thought may be quicker being electronic

It was taking about 1 or 2 months if biometrics were reused. If new biometrics were required, then it was depending on the ASC backlog.

I recall the letter mentioning the biometrics would be reused. Can we submit a outside of processing time for EAD renewals?

That would depend on the current official processing time on the USCIS website since it's the same for both first time and renewal.
