Thank you thats exactly what I was told this is the 1st time I am hearing that I need to get a ITIN for proof of a bona-fide marriage, and I don't need to amend anything they aren't understanding me my accountant told me when I went to file my 2020 taxes I was registered as MFS and she said until he is here do not file as I was told to wait until he is here and file my 2020 and 2021 jointly I only have my taxes from checks withdrawals for taxes files under MFS. I never filed 2020 as MFS so nothing to Amend. Again thanks 😊

forget the affadivats /they are of little use

and forget the western money sent to Tunisia  that is really a red flag

go to USCIS website or here under guides and see the real proof you need 

 

we did send a few chats from beginning to end but that was a long time ago

to USCIS chats don't prove the relaitonship is anything more than friendly and they use to ask for them but not so much anymore

From uscis i got the information and they already make a section for affidavit sworn from family and friend and uscis said if i dont live in tunisia i must upload photos , chat log , letter between us , i think u need some updates about online filing because there is full section to apload affidavit , and we already 4 years together ,  married after 1 year of physicaly meeting and that attached photo is from immigration lawyer , 

Having a joint things in usa is red flag as i never was in states

Your documents look good, you can reduce your chat log, can send just samples from different time frames.  You don't necessarily need ITIN.

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

You stated that you could file single.  That is incorrect.  You stated that your spouse could not get an ITIN because he'd never been to the US.  Also incorrect.  Obviously if you filed MFS there is nothing to amend.  No one ever stated that there would be.

Huh?  No, it is not a red flag.  USCs with alien spouses abroad can and do add them as insurance/account beneficiaries, add them to auto insurance, name them as DPOA, draw up joint wills, etc.  @Jeanne Adilis someone who did some of these very things before her husband ever got here.

 

You have some strange ideas.

 

Also:  affidavits from friends and family are weak evidence, since no one is ever going to write one that is not 100% complementary about your relationship.

I understand what your saying but without power of attorney or a ITIN number and my spouse never being here I cannot file jointly or add him to anything that requires his ID, signature and presence in front of an bank agent or notary or lawyer. So how do we do these things is what I'm asking and apparently thats what iscis asks other proofs.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
