I-485 Notice of Initial Evidence for Submitted copy of birth certificate (merged topics)

Dear Folks,  I filed I-485 along with cover letter listing enclosures to include "A Copy Of Birth Certificate".    Package also included copy of birth certificate after pages of my passport.  I think last few pages of passport were boring without much significant info; then the birth certificate copy was placed along the attachments.      Is it possible for USCIS folks to just miss to notice the page and issue a request for initial evidence for birth certificate; even when it is included on the package?       How can I tell if they noticed the birth certificate and are asking for something more specific?    Even then, the RIE letter does not mention anything specific on the birth certificate that they are expecting; rather, it seems to be a copy and paste of "birth certificate" requirement as evidence.    Nonetheless, I have attached parts of cover letter, copy of birth certificate (obfuscated personal info) submitted with I-485 packet, and then request for initial evidence letter received on this post.     

 

We would like to respond  with appropriate documentation, even if it resending the copy of birth cert, or more.   What might might USICS be expecting here?    

 

Would a kind soul share expertise/experience/recommendation with sincere generosity here?

 Because it's an RFIE, i am assuming they did not see that copy of the BC. If they had seen that, they would have sent an RFE for secondary evidences due to the late registration/issue of the certificate.

 

To avoid another RFE or denial (uscis has been denying bunch of cases without issuing any RFEs), my suggestion:

Respond to the RFIE with the following:

1. Copy of the BC

 

Because the birth certificate was issued lots of years after the birth, you need to provide secondary evidences as well like below

 

1: Affidavits of Birth: one from each parent works ( google template and you'll find a bunch)

2. Copy of Nepalese Citizenship Certificate

3. Any school or hospital records showing your name, DOB, parents name.

Ok, thanks for the advise; will add in  Affidavit of Birth and along with BC copy - since my parents are here in VA;  they will feel good to be genuine affiants.

 

to Clarify remaining doubts regarding the BC copy submitted (our own only after receiving RFIE): 

 

Is it necessary to copy BC in color so that official stamps/logos are more prominent.   When I filed - I made all black and white copies - I think instructions said its ok.    What might be better? (this would be the only evidence in color if we send in color)

 

Also instructions seem to indicate that words such as "registrar", "secretary" etc need to appear;  in Nepal we didn't have those authority titles in that village - we have "Ward Chairman" etc.        I assume this (or any content for that matter on BC) was *not*  the reason to issue RFIE. 

 

Apparently on the BC copy submitted:  he country name "Nepal"  is not explicitly mentioned last sentence, after district; "Parbat" for place of birth.    Country appears on head of the letter though.  Would this even be an issue?

 

Is it customary to call USCIS and to talk to  someone there clarify what exactly was the reason for RFIE;   is that a good idea or necessary even?

Not mandatory but you can send a color copy if that's more readable.

 

Mine was also similar to yours issued by VDC office few years ago.

 

Visa reciprocity for Nepal doesn't mention anything about secretary or registar, so i don't think that's required. The notice you got is generic.

 

Calling uscis for clarifications is useless. They will just repeat what the RFIE says.

Ok, trying to pick a "best" template to prepare Affidavit - before getting father/mother in front of a Notary.   Some template include both father and mother in one letter and some seem to have different letters.  e.g. following includes both.   I remain curious if there's requirements saying it has to be two separate ones from father and mother (?):

Hi Dear, I received a request for initial evidence for birth certificate even though I had a submitted a BC with my I-485 package.    Now the best guess is that USCIS also wants secondary evidence of my birth; thus I am responding with two affidavit of my birth from father, and from mother, notarized by a Public Notary, along with a clearer copy of my late registered birth certificate in Nepal.

 

Question I now have is:   should I send photocopies of notarized affidavits of birth or or send original notarized affidavits?

People get RFE for BC bcoz they send it very short form. Your BC is short form? They request for long BC. With details.

It's a RFIE (instead of RFE) I received.     BC submitted is like any other "delayed"  birth certificate letter by authorities there for folks who were born in 1970's in that area of Nepal.    There was no any type of birth registration/certification system there then.    A copy of BC submitted is posted on this thread:

I don't have specific advice but can share my experience. I had the one-page birth registration certificate from the local ward office, which was in both English and Nepali. It was printed in 2016 so registered late. I only included a regular non-notarized copy, and I didn't get an RFE. I'm not sure why you got an RFE for it. I wonder if they misplaced your BC.
