So was it “broken” by the lawyer? What you’re explaining is not unusual. It’s sometimes stated on the visa application as a means to get a tourist visa to show strong ties to their country. That’s the issue as you already stated. But it’s not as simple as saying he was never married. He was in a common law “marriage”. He will need to show that “marriage” was dissolved, same as a regular marriage.

We have that paper that dissolves the common law marriage even signed by the same lawyer , that was used for the first document. (Including dates)

Somebody else filed the papers for him in Dominican Republic.. at the visa interview they asked him if he was married in wich he replied he was in a  “ free union” wich is basically like a common law marriage(usually to get Heath insurance for the girlfriend & kids) except you are not married nor get a marriage certificate.. you go through a lawyer and it’s usually broken by the same lawyer.. I don’t know if you can understand what I’m trying to explain lol.. mind you he got his tourist visa 4 years before me & at that time he was in a relationship with his sons mother and they were living together. I will keep everybody posted .. this has been a roller coaster!

It appears you sort of answered the question.  Did the person who filled out the DS160 check the box that said he was married?  If so, this could be a real issue and possibly why they came for a visit.

Yes, they did. My husband said he was unaware of that .. he Paid somebody in the Dominican Republic to fill out those papers.. when he got the interview. He answered what I stated earlier. He even clarify it was a “ free union “ & brought that paper with him but they never asked him for it. Or any other papers for that matter except his ID.

Op, I think you are not taking this as serious as people are pointing out. If he stated on his B-2 application that he was married, USCIS will need legal evidence that, that marriage has been dissolved. It can't be brushed aside as far as USCIS is concerned because there are so many immigration fraud in the system. Good luck.

We are taking this very serious .. we have a lawyer and are prepared for anything at this point . We know our truth and we are going to do what we have to do to prove what they need us to prove .. my question here was if anybody else has gotten a visit from USCIS & I think people think I’m confused as to why I got a visit. I know why.. I know is going to very hard to prove my case but not impossible.. I met one person with a story very similar to mine if not worst and it took years & they got GC APPROVED .. My husband might get it, he might not.. but we will fight til the end, that’s for sure.

Thank you for the positive vibes.

Visits from USCIS agents are not common, but they do happen.

We all responded to the part where you said you submitted the paperwork and started to explain that he was not lawfully married. You can do a search on here to find other stories about immigration home visits, it’s not uncommon at all. As far as how long it will take, I don’t think anyone can answer that but hopefully you will hear something aoon so you will know your next move. Good luck’

You can obtain a copy of his B application using the FOIA, so that you’ll know for sure what you’re up against.

A dissolution should be signed by a judge, not a lawyer, right?
