Establishing Domicile

Good Day People.

 

Hoping each and everyone of you are safe and healthy wherever you guys are. 

 

My wife (US Citizen) and I (Indian Citizen) recently started with our Immigrant Visa procedure and our submitted documents have been accepted by the NVC. However, they have requested for my wife to submit proof of domicile as she has been living with me in India for the past 4 Years. 

 

Currently, she is maintaining a Bank Account in the US along with Credit Card as well as has a Physical Address (her Aunt's). Her DL has expired and same cannot be renewed online. She religiously files her Taxes as well for the state of Florida. 

 

Please advise what other documents would be required to establish domicile.

What kind of Florida taxes? Florida has no state income tax...... She needs documentation showing that she is taking concrete steps toward returning to the US...such as looking for a place to live, seeking a job in the US,  talking with schools, etc.  Does she own any property in the US?

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Rule isn’t proof of domicile.  Rule is proof of intent to establish domicile.

 

Our list:

Current drivers licenses (c’mon dude expired drivers license just looks bad)

Vehicle registration and insurance

Filed taxes

Bank accounts

Credit card accounts

Storage fees - we had stuff there

Retirement accounts

Mobile phone accounts

All addressed to one place.  Brother’s house

It’s ruinously expensive to “maintain US domicile” while overseas.  Based on what you submitted you should be DQ’d but she needs to start doing some business in the US and that means moving assets and establishing real ties.

Thanks Lucky Cat for your valuable inputs.. She doesn't own land, however, I do, which I had purchased as an Investment. Would that help??

Not necessarily.  Intent to re-establish domicile means intent to actually reside/live in the US.  Owning an investment property doesn't always mean that.  The petitioner/sponsor must show evident steps to return to the US to live.
