December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Maybe consider getting a second job, or looking for a better-paying job.

So i called my lawyer and explained that getting a sponsor looking dim, so i suggestesd to still file motion to reopen and use my current gross income x 26 and that would put me at 26 k she said it would still get denied?

Yes wife got an ead card and a ssn but then was denied two weeks later has me stumped

I only made 14700 due to pandemic i called and wrote letter explained why so low due to pandemic only half yr work sbowing i even called and they said the put a note on my file

I know @Aspire5532 personally.

I haven’t seen the entire I-485 package but I believe he did not submit a current pay stub which would have shown his annual pay rate was just over $26,000.  

 

In the RFE he was asked to send his complete 2020 tax return and w2 and to send an I-864 for a joint sponsor.  In the denial letter from uscis, uscis says that he sent just the w2.  

 

He assumed that his phone call with USCIS settled the matter not understanding that he was talking to a tier 1 officer and what that means.

Did you write the letter in your response to the RFE, or separately? Did you include a pay stub from 2021?

Everything I’ve read on visa journey  says that current income is what matters.  
 

The lawyer tells @Aspire5532 that he doesn’t earn enough but he does. She says that if they file I-290B without a joint sponsor then the motion will be denied.  


I asked him to ask the lawyer how much does he need to earn in 2020, and the lawyer replied with $21,500 and then $22,000 (the correct answer  is $21,775). Even after being informed he earns $26,000. 
 

Logically  if the petitioner sponsor can exceed the 125 percent poverty minimum, and still be denied, then so can a petition that includes a joint sponsor. 

FWIW the lawyer also told the couple that a joint sponsor’s commitment is for just three years which I advised @Aspire5532 is 100 percent false. 

 

So let’s assume the lawyer is competent for a moment ...  Why would the I-290B with his most recent pay stub and an employment verification letter, the amended 2020 tax return (amended due to the alien spouse now having an SSN and thus lowering the tax burden as well as getting stimulus money), the w-2 all be enough to get approved?
