Avoiding Conditional Green Card

My wife was just approved for a immigration visa (CR1) and we are making plans to enter the US. Our 2nd year anniversary will be in about 50 days. Does it make sense to wait until after our 2nd anniversary to enter the US so that she will not receive a conditional green card? Are my assumptions correct on how this works? OR she will still get a conditional green card because the visa on her passport is CR1?

Agree 100%.  In reality, only a very small percent of I-751s are actually denied.  They should eliminate the 2 year green card.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I'd also highly recommend to enter US after 2nd year anniversary unless you are restricted by visa validity. You don't have to worry about ROC at all.

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Timeline

If the 2nd anniversary is as close as 50 days from the issue date of the visa, I would also recommend waiting for the anniversary date to enter.  One thing I would add if you take this route, make sure your wife pays close attention to CBP when she does enter, the visa will most likely be classified CR1, but she may need to offer to the CBP officer that you are now both past your 2nd anniversary.

I agree with everyone; wait and enter after 2 year anniversary. An added benefit is that you'll avoid the current $680 total fee to remove conditions.

14 Apr 2021: Submitted I-864, I-864A and DS-260

14 Apr 2021: Expedite request

04 May 2021: Expedite approved, case sent to Consulate in Naples, Italy

 

US Consulate Naples, Italy

04 May 2021: Consulate received

18 May 2021: Requested expedited interview

20 May 2021: Expedited interview approved and scheduled for 8th June

07 Jun 2021: Medical at Istituto Varelli (Naples, Italy) - Very friendly staff, spoke English

08 Jun 2021: Interview - APPROVED

09 Jun 2021: Picked up passport with Visa in person from Consulate 

 

USA

17 June 2021: Entered New York (JFK) as Point of Entry

17 June 2021: Landed in Arizona and reunited with my wife :)

Wait until the day after your 2nd anniversary to enter the US. They will give you the 10 yr green card.

Wait until after your 2nd anniversary - you’re so close.  You’ll avoid the whole ROC process.

And make sure she’s got a copy of the marriage certificate with her when she travels.

I agree.

 

This “reform” did the exact opposite of what it intended.  It hamstrung INS —> DHS from enforcing INA on fraud cases and due to the divorce waiver made it easier to commit fraud.  Meanwhile people with legitimate relationships are punished.  
 

I echo the advice to bring a certified copy of the marriage certificate to the port of entry.  Show it to the CBPO processing the CR1 visa.  By doing so this will reduce the chance of mistakenly being issued a 2 year green card and being forced to file I-90 to get the correct card.  
 

Also beware of “time travel”.  You can leave say Japan on July

2 and arrive in the USA on July 1.  
 

Wait a full two days after your anniversary so that you arrive one day after the date of your two year wedding anniversary.
