Hi! This is a question from my friend. I already have a green card and he is the process. I firstly would like to mention that he is already seeking legal help and wants to know if there is anyone here that went through similar situation as him. He was banned from USA for 10 years due to overstaying, he was in US with his finace, they got married in Europe after. His husband had to go back to USA and he tried to enter again after 5 years and the CBP officers let him in even tho he has that 10 year ban. Whilst he was here he applied for i485;  month after his interview he got a letter stating: " USCIS is providing you opportunity to submit additional evidence and information that you believe may overcome the ground for intent of denial pursuant ". His lawyer has advised to apply for waiver. (they took over a month to reply to him!)  Has anyone been in similar situation and is willing to advise?
