Change of Petitioner possible after its approved?

Hi VJ Family! 

 

I have a question. So my uncle had a petition approved by my grandmother but my grandmother passed away last July 2013 so they changed the petitioner into my Aunt. So now the situation is, My Aunt don't want to continue the petition for my Uncle now. One of my aunt wanted to take over the Petitioner as a the sub / affidavit of support. Which office should we call now to conduct the change of Petitioner to proceed the petition? 

 

The case is already in National Visa center. It was appropriate 3x already. All they need was the affidavit of support, medical and for interview. But the loophole is the change of Petitioner.

No.  A change in petitioner in this way will need to be done via an entirely new petition.   A petitioner withdrawing the petition isn't exactly a "loophole."

I’m a little confused with all the aunts and uncles but why doesn’t the aunt who wants to sponsor, just be a joint sponsor and the original aunt stays petitioner? If you start all over again now these aunts and uncles will all be grannies and grandpas by the time the petition is done.

The original sponsor (Aunt) wouldn't proceed because she had a conflict with the brother (recipient). So now, another Aunt wanted to take over the Sponsorship/Petitioner. I know its complicated.

It's not complicated. If the petitioner has beef with the beneficiary and no longer wants to proceed with the petition, the petition is dead. Another person who is eligible to petition the beneficiary can start a new petition.

Doesn’t work like that, it worked before because there was a death. The non-conflicted aunt can file a new petition now, as you know it will take 20 or more years from now for a new petition.
