I also went and looked back in the post history and something isn't quite right. In 2019 you posted that you were the immigrant and Deb was going to be filing either the K or CR. Now you and Deb have a duck farm and she is in a detention center and you are the USC who can rescue her by a quick zoom marriage but the problem is the ducks. They will have to be sold to free your love from jail. Umm. Any thoughts from the mods?

A few things..

 

1. lawyer.

 

2.  Her overstay is what got her deported.. not the red light.  If she gets a interview for a visa in the future and she blames her deportation on the red light, I'm sure the consular officer will laugh at her.

 

3.  2+ years (about 2 years was overstay) in the US, you had more than enough time to marry and file for a greencard.  Possibly even enough time to have removed conditions 😅

 

4.  As others said, getting married most likely won't save her from deportation.  I think the best thing to do would be to try for a k1 or spousal visa with the appropriate waivers once she returns to  Canada and keep your fingers crossed that the waiver is approved.  But expect it to be denied. 2 years is a long time to overstay.

 

Possibly look into moving to Canada would be the easiest route.

 

And definitely consult a lawyer as waivers will be needed for deportation + overstay.  You might have to take out a large loan to pay for it.

She should've been on a k1 or cr1 visa when she first came over 2+ years ago in my opinion.  Everyone going through this process has to be apart from their significant other for this process for long periods and coming over on a tourist visa to skip that line... Not cool. 😅

 

Canada also is right next to us.  You can visit every other month if you can afford it. 😅  That's what I did for my wife in Mexico. 🇲🇽

This is just a thought from a random stranger for you but...

 

After reading what everybody says, at this point, instead of rushing to find whatever lawyer you can get your hands on now and gather money for it, wouldn't it be better for you to wait for her to be back in Canada, and in the meantime you research for a top notch lawyer, then you go to Canada and get married there, you come back to US and file for CR-1, and get the lawyer for the visa process?    When I was in the US years ago as a student, the roommate of my friend got deported for overstaying for a few years.  She found a lawyer for him but once he was caught in the system, it wasn't much the lawyer could do because the reality was that he was overstaying illegally no matter what the reason was.  I don't know anything legal on this kind of matter and I'm not saying the same thing will happen to you but that's what happened to somebody I knew.  

 

You keep saying it's ''not fair'' that two people who are in love get separated or you can't be separated because you two love each other too much etc but immigration doesn't give a damn about your personal situation.  Every genuine couple who goes through marriage/fiance visa process feels the same way as you do yet we choose to take the necessary step to be together and endure the pain during the separation because that's usually the only way to make the situation ''fair.''

 

Since you are not financially in the position to afford a lawyer now, maybe you should spend more time finding the best option to get the expense for a superb lawyer as a preparation for the visa process.  To me, that seems to be more considerate and practical way of using your money and attorney for it.
