Hi everyone,

please I need your advise. I had an interview in 2019 for the petition my mum put in but on the day I was told to go back and get DNA. They also said mum does not live in the states because she was always traveling. I explained she was the main carer for my grandma that’s why she was always traveling but the interviewer wasn’t having it. He said he does not believe she is my mother. I left with the document stating I need DNA. We got the DNA done then covid started the US embassy in London stopped processing my visa type. Last month I got an email from the embassy saying they have started processing my visa type, I need new medical, new UK police report, updated DS260 and then email them to book a new appointment. 

I am just wondering what other document I need to take with me. The embassy referred me to its website when I asked documents to come but confirmed they have a copy of my DNA result.

 

I am trying to avoid another wasted time, money and effort. 

Please can anyone advice me on me on what document I need to go with and the chances of me getting the visa to join my mum. My in-law is also supporting the application because my mum does not work and she only has a green card.

The purpose of those visas is to reunite family.  If your mother is not currently living in the US, there is no reason for you to have the visa, so it is no wonder that it was denied.  Unless she is now living in the US, you will have the same result this time.

If your DNA is proving the relationship then the only thing you need to worry about is your mother’s domicile. How much time has she  been spending in the US since your last interview?
 

btw: Telling them she is the main carer for someone who lives outside the US is just as good as telling them she doesn’t really live in the US. She needs to be spending more than 6 months a year (preferably significantly more) to be considered living in the US. As above, if she is not living in the US then the entire reason for giving you a visa -family reunification - is not there.

She spends more than 6months in the US and she's been there since my last interview without travelling as my grandma has now passed. 

 

The DNA shows she is 99.9999% my mother.

I’m sorry about your grandma.
That will be helpful to your case though. If she is mostly living in the US and the DnA proves the relationship (and the joint sponsor is acceptable) then there appears to be no reason for the case to be denied.

Yes she is living there and not travelled since then

What documents will I go with? I forgot to add that my inlaw said he owes tax and has a payment plan already in place. Will that affect the application?

I do. I will send you the list I have and what I took before. The interviewer did not check any of the documents. He was just insisting that I am not the child of the petitioner. 

 

Below is the list I have for myself but I want to be sure it is correct. 

 

New Affidavits of support  (form I-864)

 

New Affidavits of support from inlaw (form I-864)

 

copy of DNA

 

Tax documents from inlaw (but he said he is owing and I am wondering if this will affect the application)

Please can you answer the question about tax. My inlaw says he owes but has arrangement to pay back. Is that going to have negative impact on my application?

Possibly.  Can’t answer that from here.  If he owes and it says he owes and he has an agreement then you may want to bring that agreement to the interview in case they ask.
