Joint Sponsor Filed Tax Married

Hi,

 

We are using my sister in law as a joint sponsor, and she satisfies the financial requirements no problem. She files her taxes jointly with her husband, but we're not using her husbands finances as the joint sponsor. Though as they filed taxes as a married couple, does he need to fill out any forms? Like a I-864A etc? Or does she need to provide any other information with her I-864, like a W2 or anything?

The tax return alone lumps both incomes together on a joint return so the NVC or embassy can’t tell if your sister in law qualifies as a sponsor on her own. It she can submit something that shows her separate income, then they know. Her W2 or an employer letter stating her yearly. If submitting her W2, I would spell it out to them. Photocopy her W2 and write in BIG writing “Proof of joint sponsorJane Doe’s separate income”. It has worked this year at NVC/London without adding her husband to the mix or the extra work of his I-864a. If using the W2, then put that amount as her current income. If you say she earns more, then the W2 didn’t prove it.

She has included her Schedule C with her tax returns. This should be enough, right?

I don’t think so. As self-employed only a tax return Is proof.  Not sure if schedule C with her name as owner of the business would work. There is a lot of self-reporting without physical documentation unless she primarily contracts to one business and has a 1099 wage statement showing enough income.
 

In her situation, I think she will have to include her husband as Person 1 on the I -864 and he will have to prepare an I-864a with his proof of income evidence.  The NVC workers will understand that and not likely the nuances of a Schedule C tax return. They aren’t tax people.

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
