Entry to US while waiting for J1 2 year waiver

Hello!

 

I've searched past forums but can't seem to find an answer to my concern.

 

I started applying for the j1 waiver after I moved back to my home country due to job restrictions and now hoping to get the waiver so I can move back to the States sooner.

I would like to visit US this summer to see my husband since we haven't seen each other for a whole year and COVID restrictions in my country make it hard for him to visit me. But the problem is that because the process is so slow I don't know if I can get the waiver before then. 

 

Does anyone know if entering the States with ESTA while waiting for the waiver would be bad? I'll make sure to have documents to prove I'm not staying, but I'm a bit worried I'll get questioned for hours at the airport or even worse sent back.

 

Any info is appreciated!

If you can convince CBP, if asked, that you are going to return at the end of your visit, great.  Showing them that you cannot adjust without the waiver might even help. There is no way to completely avoid the risk.  Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
