Is it time to sign the PAPERS?

Greeting everybody, I hope everybody is doing well! I want to share what’s going on in my life at the moment and see if I could get any help from the community.

I’ve been married for about 2 years but we are no longer partners but we still living in the same place but in separate rooms, I’ve been a Green Card Holder for about 8 months, and this whole situation has always been hell since we got engaged, my partner has always been aggressive verbally and physically towards me and on top of that, she starting doing drugs (cocaine) and I’m concerned that could get me in trouble. Since I stopped letting her do whatever with me, she has been threatening me, saying she will deport me or cut herself (Which has happened 3 times) if I don’t do what she wants/needs! There is a good amount of people who have witnessed some of her actions and also messages of her being verbally aggressive towards me. My question is what kinda lawyer should I be looking at this point? And also how would that affect my ROC process?

It’s unfortunate you went with the marriage when you saw it falling apart before you tied the knot! I wonder why you’d marry someone like that but that’s not here nor there... She can threaten you all she wants with deportation but you guys proved a bonafide marriage to get you here. You should look to a divorce lawyer - you can file removal of conditions on your own with a divorce waiver. You said there have been a good number of people who witnessed her verbal aggressions towards you- does this include police as well? A police report/restraining order may be needed if you feel your life is in danger. If you feel she will harm herself o suggest calling 911 as well-sounds like she needs at the very least a psych eval. I suggest finding the divorce lawyer ASAP and move on with your life. Best to NOT be living in shared space or be alone with one another...especially with drugs involved... As long as you entered the marriage in good faith I wouldn’t worry about immigration- you have over a year before you have to file ROC as it is. Sorry you are having trouble with your marriage.

 

Since you have a conditional green card you can successfully remove the conditions of your green card alone without your spouse, if needed.

 

You most likely need a family attorney to put together a divorce for you. You can file a i751 waiver case alone if you have a divorce decree. You can also file a i751 waiver application alone if you can prove physical abuse or severe emotional abuse. So, your spouse can not stop you filing for your 10 year green card yourself without her.

 

Right now, collect as much evidence as possible proving a good faith marriage from your wedding to today; joint tax returns, joint bank accounts, joint lease info, copies of IDs with same address, everything you can collect you will need it for whatever i751 removal of conditions application you file.

 If you spouse is abusive you need to collect as much evidence as possible of controlling behavior, abusive text or emails, bulling messages, police reports, and medical records.

 

You should consider removing yourself from the home if you are not safe, if she accuses you of abuse it will complicate you immigration case so never engage physically or argue with her too vigorously. Document as much as you can.

 

With adequate good faith marriage proof you can easily get an i751 divorce waiver case to remove the conditions approved. The divorce waiver is easiest to prove you only need a divorce decree with good fail marriage proof. All i751 ROC applications waiver cases require some good fail marriage proof up to separation.

You should remove yourself from a home with drugs around, any dug charge against you due to her possession of drugs in your shared home could permanently bar you from getting a green card or citizenship.

 

Collect good faith marriage evidence and move out as soon as you can.

Hey Kojodub! You don't even understand how much I feel you lol, I751 divorce waiver here

You must get yourself out as fast as you possibly can, and try to get a  restraining order (one of the biggest proos of abuse) gather all evidence you can, and remember, you you can prove an abuse, you don't need to wait for your divorce to be final and also you don't need to wait for the expansion of your GC, you can start your I751 right now, but you also must remember that proving an abuse is very very very hard, you must take hire an immigration lawyer 2his going to help you to put everything together, and you better off to take a lawyer BEFORE you leave the house as the lawyer will tell you what is the right way to do so!!!
