American man impregnated and abandoned his Filipina girlfriend 10 years ago

Please help if you are knowledgeable about this case. Here's the situation. 

 

I am US citizen and I am helping my Filipina friend who got pregnant to an American man and abandoned her 10 years ago.

 

My friend is a Filipino citizen, single parent and currently living in the Philippines with her daughter (10 years old).

 

10 years ago, she met an American man and stayed together until they learned that she was pregnant and the American man left and never seen again. The American man didn't give any support to my friend and her daughter since my friend was pregnant up to now. They are not married.

 

We want to know what steps/guidance my friend can do to for her daughter to get her citizenship. My friend knows where the location of the American man in the Philippines. He has his own family now and lives in Visayas area. We want to know what documents or process to expect in order for the daughter to become US Citizen. 

 

Thank you for helping. This is a big help for the 10 year old girl to have a better future. My friend is not after the financial support. She are after the child citizenship (which is the child's right).

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Child support would help.

 

Is his name on the birth certificate, did they do a DNA test, how has he acknowledged her as his child.

You need to prove paternity which is unlikely unless he cooperates and takes responsibility

There is no child support. He is a deadbeat dad.

 

His name is not on the birth certificate. No DNA test done. He acknowledge the child "verbally" when the child was 2 years old but then gone again.

 

We have a family law attorney in the Philippines but she isn't a specialist in immigration/citizenship law. We are ready to put pressure to the deadbeat dad but we want/need to know what he will need to do for citizenship paperwork, proof, etc. (So we can push him with those specifics) - We seek legal expertise re all that is required for proof and paperwork. 

 

We are seeking an immigration/citizenship attorney that can help with the evidence and paperwork needed.

 

In the past we used Mac Ellis who is recommended through visajourney but he doesn't seem to be active anymore.

Go to the embassy website and learn everything about the Consular Report of Birth Abroad (crba).

We have done that but still it's not clear about this specific case and what they will ask for. Do you know a good immigration/citizenship attorney? or someone who has gone through this process with a deadbeat dad?

Timeline

The father will need to accept paternity.  Then, he needs to provide proof that he meets the US residency requirements to pass US citizenship on to the child.  

If he will not cooperate, then paternity needs to be established through the court system.  After paternity has been established, then the court may be able to compel him to provide the necessary residency requirement and/or file the CRBA.

Agreed with others. No immigration/citizenship lawyer can do anything unless you have the evidence that the child is the daughter of the mentioned US citizen. First focus into that evidence which, based on your post, seems long way to get.

Philippines in 2018 according to PSA (Philippines Statics Authority) over 53% of the children born that year were born out of wedlock.

 

There country is full of illegitimate kids, as you are probably well aware of.   It's common for a Pinay to claim the child is a Foreigner child, I had a buddy living over there who had a vasectomy he was accused of fathering a child.

 

You walk down a barangay in the streets of any province you will see a ton of kids, and more than half are illegitimate
