Updates to National Interest Exceptions for Regional COVID Proclamations

Last Updated: April 8, 2021

The Secretary has determined that the travel of immigrants, fiancé(e) visa holders, certain exchange visitors, and pilots and aircrew traveling to the United States for training or aircraft pickup, delivery, or maintenance is in the national interest for purposes of approving exceptions under the geographic COVID Presidential Proclamations (9984, 9992, and 10143).  These proclamations restrict the entry of individuals physically present, within the 14-day period prior to their attempted entry into the United States, in the People’s Republic of China, Islamic Republic of Iran, Schengen Area, United Kingdom, Republic of Ireland, Federative Republic of Brazil, or Republic of South Africa. This article provides further details regarding this determination.

As with all national interest exceptions for qualified travelers seeking to enter the United States under a Presidential Proclamation, if circumstances warrant, the Secretary of State may revise the national interest determination.

National Interest Exceptions for Immigrants and Fiancé(e)s

On April 8, 2021, the Secretary of State determined that travel on an immigrant or fiancé(e) visa is in the national interest for purposes of granting exceptions under the geographic COVID proclamations.   Immigrant Visa processing posts may now grant immigrant and fiancé(e) visas to applicants otherwise eligible, notwithstanding these proclamations.

🙄fine I’ll rephrase if you want to pick on my grammar choice.

SINCE a k-1 is exempt form these restrictions then why wouldn’t it be possible to transfer to the next flight?

I only meant I haven't found that a K-1 is exempt.  I wasn't questioning your grammar.

Thank you! I was going to ask the airlines, but can't really expect them to know.  That answers it! So relieved!

Have her print this out and highlight it... the airlines should know but she has written proof with her it may ease her and your mind. :)

To expand on this subject, I recently passed my Embassy interview and received my K-1 visa (woo!).

I now plan to travel from the UK to the US to marry my fiancee in the next week, and from what I've read, K-1 visa holders, despite being in the UK which is restricted per the presidential proclomations, is fully exempt?

This is what I've gathered from you fine, educated people. But, my question is, is this an 'automatic' exception for us K-1 holders? Or do we still need to apply for this exception before we fly?

I really don't want to present these links and be turned away because I didn't request an exception form, or something of a similar manner..

Any information would be great, I have spent hours googling, and these links give me hope, but I want to be double sure I'm not missing something simple.

Thanks guys and all the best!

She is going to still have to have a negative covid test 3 days before travel to the US. I saw this mentioned in an earlier post. She is exempt from the ban, but everyone, even US citizens are required to have a negative covid test before flying to the US. Make sure it's a legit PCR test, and meets requirements. Took me a few places in Rio de Janeiro to find a legit PCR test so I could return to the US a few months ago. Sometimes they offer them at the airport.

Here on a K1? Need married and a Certificate in hand within a few hours? I'm here to help. Come to Vegas and I'll marry you Vegas style!!   Visa Journey members are always FREE for my services. I know the costs involved in this whole game of immigration, and if I can save you some money I will!

They have different types of covid-19 tests. Usually the rapid tests that give results in an hour aren't valid for the CDC. Some are rapid tests with results in 10 minutes that you can do at home. Those aren't PCR tests. Usually PCR tests have to be completed in a lab, though I have heard of some airports doing PCR testing with results in a few hours, but those are pretty pricey. I was offered a bunch of fake PCR test results for like 20 dollars also that would supposedly get you on the plane, but all it takes is some (removed) retentive CBP officer that actually calls or goes online to verify the results, and your in a world of hurt if your caught with a fake PCR test. In Rio a legit one cost be a little bit more than 50 bucks, and had results next day via email and text, and I printed it out at the business center in my hotel and was good to go. But your friend is more than welcome to buy a 20 dollar fake PCR test. They are out there.

Actually, the US accepts a pretty wide range of tests but be sure to check the list. As a USC I had to get tested to get on the plane to leave the Philippines last month and to be able to transit Taiwan but nobody gave a darn on arrival.  Hahaha

The USA accepts PCR and Antigen tests (aka "rapid tests").  That is clear in the rules.  (and I know this first hand having read the rule myself and my fiance flew from Mexico to the USA with "only" a rapid antigen test, and I know dozens of others that have traveled to the USA with only a rapid antigen test).

That does not mean that either your airline, your starting city or any connecting airports don't require PCR...

Or that all of those entities will allow a test from the same amount of time in advance of your flight departure or arrival time. (some have 2 day rules, some 3 days, some are "before flight", some are before "entry time").

Use google and find the rules for where you are departing from, your airlines, any transfer airports and the country you are flying to.

That is the only way to be 100% sure that you are in compliance with all requirements.

Or don't and hope only the USA requirement will get you thru (it will in most cases, but not all).
