I want to change to CR1. I am still waiting for NOA1 of I-130

It was such a painful procedure.

My husband called USCIS and they put a notice to send another NOA1 out again. We submitted I-130 end of April to NSC and it was forwarded to CSC end of May. So essentially our case was entered into CSC as a May application.

Now we are still waiting for NOA1 which takes such such a long time. We decide not go with K3 now but stick with I-130 for CR1.

My question here is that we put the statement on the I-130 cover letter that we will apply for k3. Is it okay that just not send in I-129 without changing anything so far? or do we need to fax them a notice saying that we want to change to CR1?

The call center person said that K3 is just 1-2 months faster than CR1, so maybe we wanna just go for CR1 now. I just started working here in Canada and it should be fine that I work for half year waiting for the visa.

April 28 2007 sent I-130 to NVC

May 22 2007 application transfered to CSC

July 11 2007 received NOA1, decide to apply CR1 instead of K3

Aug 14 2007 touched (not sure if it is touched before Aug 14)

Aug 21 2007 NOA2 in snail mail :)

Aug 27 2007 NVC received our case, number is assigned.

Sep 11 2007 DS3032 and AOS bill generated and mailed out

Sep 12 2007 mailed out DS3032 from Canada and hubby mailed AOS bill in US. DS3032 will arrive NVC 3 days slower than AOS bill.

Sep 18 2007 Auto msg says NVC received DS3032, didn't mention AOS bill yet.

Sep 24 2007 IV fee bill generated

Oct 8 received IV fee bill. Still waiting for 864form

Oct 13 received 864form letter. It was issued on Sep 24 at NVC. Mailed out 864 on Oct 15

NVC agent said they don't receive IV fee bill nor 864. Send out IV fee bill again end of Oct.

Nov 8 IV fee bill entered to system

Nov 12 DS230 generated. But agent still said 864 is not received yet.

Nov 20 resend out 864 again(Hubby forgot to write case number on documents last time)

Nov 27 NVC Auto message said received 864, now waiting for 230

Nov 29 230 delivered. Will arrive at NVC next day.

Dec 3 NVC received 230 and put into its system

Dec 13 NVC operator told us the case is in administrative process.

Dec 14 Called operator again, and magically the case is completed!

You need to let them know that you are no longer going to pursue the K3 or else they will hold your I-130 at CSC until the K3 arrives. You must ask them via, e-mail and also request with a letter, but if you do not let them know then they will sit on it while they wait for the I-129F.

I'm not personally experienced with this, but it doesn't sound quite right. As far as I knew, as long as the 1-129f doesn't get approved first, then they won't sit on the I-130. Mentioning the K3 in a cover letter shouldn't be that binding.

Also, to the OP, do you mean NOA1 or NOA2? Waiting since April just for proof of recipt (that's NOA1) is a very long time and seems like something would be wrong. Or is that the first one went missing in the post and now they're sending you a new copy?

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

If there is no I-129F filed, and approved before or at the same time as the I-130, the I-130 will be sent to NVC. You shouldn't need any notification but it wouldn't hurt to send it anyway.

CSC has been way behind in sending NOA1 receipts, so waiting this long is not unusual at this time.

I just wanted to add that the call center person might have just given you an average time estimate. If the K3 is being processed through Vancouver you could have you visa in as little as 3-4 months. The CR-1 which goes through Montreal is currently taking about 8-9 months.

If you would rather spend more time in Canada and save up money, then by all means the CR-1 is the route that would best work for you. However if you would rather be with your SO sooner then the K3 is the better option.

I can't imagine what you thought you were accomplishing by putting the statement about a K3 visa in your I-130 cover letter, but it was most likely ignored.

I did the same thing you did on my cover letter for the I-130. I also waited ages for the NOA1 and received it 2½ months later. So, we chose the CR-1 route instead as well and are almost done at the NVC. Don't worry about letting the USCIS know about the I-129F, like some have said, they really don't care.

Do you mean 3-4 months in total or 3-4 months after NOA2?

I heard people say that Montreal is very slow at scheduling interviews. If 8-9 months is the time that proceed from begining(NOA1) to having the interview, then it is not bad at all!

I don't think I would be as lucky as you are that get NOA2 in 4 months. Since there is a big slow down in April, all the cases may need much longer than usual.

But, at least I am more confident in pursuing CR1 route. Good luck to all of us~
