Hello everyone

 

I am asking on behalf of my brother. His Noa 1 receipt date was Oct 6 2020 and it went to California center. He finally got some movement but they have requested for additional documents from him. He and his fiance, who is also my first cousin, known eachother their whole lived and they are requesting for additional evidence of their engagement and how they are first cousin. What I wanted to know what the acceptable or permissible evidence for that? 

 

They have requested additional information as well, mainly affidavits from others who were present and assurance of bona fide marriage intentions once in USA. 

 

If someone had experience with first marriage cousin cases or has similar one, your help would be appreciated.

first the state they marry in has to accept 1st cousins marrying

next you need proof of the cousins relationship so produce the series of birth certificates that would show how they are cousins 

example my mother and sister birth cerificates and birth cerificates of children from those 2 would show they are cousins

then -this is your brother ,  do an affidavit for him saying you are aware of the pending marriage and will witness it when his fiancee comes to US

affadavits are easy -there are samples online

The case will likely only progress if your brother lives in a state that allows cousin marriage (or at least recognizes cousin marriages done in another state or country).  This varies state to state, and there have been posts on VJ that mention the USCIS officer saying that the visa will only be granted if the petitioner moves to a state that allows cousin marriages.

the allowance of marriage is not an issue because our state does allow first cousins' marriages.

 

I guess I wanted to know what was acceptable proof for first cousin. Thank you guys.
