Paris Embassy - Potential K1 Transfer from London

Hello!

 

I'm hoping someone can advise us about what to do.

 

My fiancé is a dual UK and French citizen. He resides in the UK, and our current embassy is London. The backlog at London is huge (easily 1500-2000+ cases based on historical data), and there's a new mandamus lawsuit being filed that we're considering joining, but we only just got our NOA2 and are worried we're not really going to see much movement in our case despite being a part of the lawsuit.

 

However, we recently learned that Paris seems to be transferring new cases from NVC to embassy only a few months after the NOA2 date. Have they basically cleared their backlog already?

 

Should we email to try to transfer our case to Paris? My fiancé's not technically a resident, but other members of his family live there, and we could theoretically use their addresses. Or should we continue with London and join the lawsuit?

 

My thoughts are if Paris has capacity and allows us to, we join the line there and potentially get an interview later this year which will also be one less case for London to process. But if that wouldn't work, I don't want to miss out on the opportunity to participate in the London lawsuit. Based on the lawyers' Q&A earlier today, they did encourage people to transfer cases if possible - another beneficiary was stuck at London but preferred Dublin due to having Irish citizenship. They said to go for it if there wasn't a backlog in Dublin.

 

Would appreciate any insight/advice, thanks!

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That does not make your fiance a resident or even qualified to transfer to Paris.  ......The immigration process requires a great deal of patience......and always has.  Good luck.

No, we know we have no standing for an individual mandamus case. However, the lawsuit needs 100 cases to move forward - those 100 cases will be a range of people who've been waiting 1+ years at NVC all the way to couples who've only just received NOA2. The lawyers have said that for couples who've only just received NOA2, they hope the cases will be processed within a "normal" time frame (previously 4-6 months after NVC received) as opposed to possible 1+ years. The deadline to join the lawsuit is June 4, so we're just not sure what to do as it's a lot of money.

Transferring to France would probably not be any faster

not only are they backed up but they process from Portugal also

no matter what embassy anyone is interviewing in,   it is backed logged with those dq'd in 2020

based on some more research, i guess the Paris embassy is requesting recent cases from NVC but are not scheduling any interviews for them as of yet. hopefully things will begin to move soon for everyone!

Wow.  You only just sent your petition in October, and you're already looking to join a lawsuit?  Even pre-COVID, people had to wait for much longer than you have.

The US Embassy in Dublin does have a backlog, not as much as London but still. Seems to be around January February at the moment. They don't accept any expedites though.

Hi I transfered my case recently as it was first filed while living in Ireland and I am now residing in the UK. I have dual citizenship for both countries and would have preferred to be seen in Dublin as it is much closer geographically to where I live in the UK but they said no way unless I moved back to Ireland for at least 3 months. I would reach out to the French embassy and see what they require in order to transfer a case as some embassies seem to be very strict on requirements. Good luck!

Hi did you manage to find out how to transfer your European fiance to Paris? We are in an identical spot  and trying to move my Dutch partner from London.  There is no way to contact the embassy to ask the transfer procedure - which is the correct way - so we are talking to NVC (very slow and frustrating as they took 23 days just to respond to our request to move with a standard boilerplate blahblah about K1 visa processing being slow at London which wasn't what we asked at all).  Our NVC number just got switched off on Friday so we are a little hopeful that maybe the request is being actioned. No idea how long a transfer will take given NVC is completely clogged up but London doesn't look like sorting their backlog any time soon.
