FILING FOR AOS

Hello,

I would appreciate it if someone could answer my questions about filing for status of adjustments. My husband came here with fiance visa, he came on the 4th of april, and got married on the 1st of June. Basically after two months. I am filled out of the forms and I am sending the DOCS on Monday, I am worried if they going to reject it because I did not file within 90 days of his arrival. Please if anyone can tell me if it's ok to file after 90 days for status of adjustments. THANK YOU IN ADVANCE!

PS: ALSO, I dont have his birth certificate, what do I do about that?

You will not be ok. You'll receive a RFE and a delay in processing your case. You must have the full version of your husbands birth certificate, and if it is in a foreign language it must be translated into english.

US Citizen's Birth Cert is not needed for filing only foreign citizen's.

I believe that her husband is the non-USC, therefore she'd need his birth certificate.

Using the guides is helpful. But giving out accurate advise is also. Since her husband is the one filing AOS he will definitely need his birth certificate, and a translated copy into English as well.

I agree... I unfortunately got some bad advice both on here and from the USCIS themselves, and now I'm waiting on pins and needles to see if my husband's forms are rejected and returned to us.
