After uploading all documents and payment of F3A fees on CEAC, we received Om April 2021 an email from NVC that all documents and fees are approved and that NVC will send to Cairo embasssy to schedule an interview

that was after the “filing date”

Now my questions:

1-what is meant by the Final action date?

2-What is the next step(s) that will happen ?

3- can we expect an interview before the final action date ? Or it should be after it

1. The final action date is the priority date for your category in table A of the visa bulletin. https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2021/visa-bulletin-for-june-2021.html
for F3 this is 1 Sept 2008. You cannot get a visa before your priority date is current.
So 3. The earliest date you can get an interview is the month for which your priority date becomes current (is listed in table A). In practice and especially recently because of the huge backlogs from Covid and the Trump ban, it will probably be later.

Thanks for the clear answer

Our priority date is 31/12/2008 (F3)

Is there any rough estimate about our expected date ?

what is Trump ban? He already left

Yes but he banned issuance of F3 (among other family visas) for nearly a year so there is a huge backlog built up. There are people who finished NVC process like you just did, more than a year ago still waiting for interviews.

Some people try predict visa bulletin moves but I don’t think anyone really knows, your date will probably be current sometime this year but because of the backlog i don’t know if you will get an interview this year even.

The petitioner is the grand pa, I have also a joint sponsor

my question is, will my case be declined in case the petitioner pass away ? or it will move with the joint sponsor?

Usually the case will fall away if the petitioner dies before the principal has received and used the immigrant visa. Very limited humanitarian exception.  The joint sponsor is only there for financial reasons.

But what do you mean the petitioner is the grandpa? It has to be a parent of the son/daughter being petitioned. Are you a derivative on the case?

I mean by grand pa that he is old, actually he is the father of my wife.

Do you mean that even if we did the interview we might loose the visa?

All the documents and process will be declined even after the email we recieved from NVC that documents & fees are approved?

Yes. In simple terms: the visa is for family reunification. If the petitioning family member is no longer there, there is no reunification to take place.

Here is one US embassy page that summarizes the situation https://do.usembassy.gov/death-petitioner-principal-applicant/ (obviously the same law applies across all embassies and all immigrants).

That is very clear answer, it is very tough that one might loose his chance after long waiting in case the petitioner pass away.

Thanks again
