Request for Evidence during Removal of Conditions Process

Timeline

My wife (the visa beneficiary) and I (the US citizen) are submitted our documentation for Removal of Conditions to move her from her CR-1 visa to an IR-1 in September, 2020. But we just received an RFE listing several more documents to submit. The first two are easy (evidence of my U.S. citizenship and our marriage certificate), but they also ask for health insurance information and our 2020 tax statement. So I have two questions regarding this because of our changed financial situation:

 

1. In 2020, partly due to COVID, we earned less than the minimum income that was required when we first filed for her CR-1 3 years ago. Will this create a problem now? Or do I need to have my parents file an affidavit of support to show that they can supplement our income? 

2. My wife and I currently receive Medi-Cal (California's Medicaid program) benefits because of our current low income. Does anyone think this will be a problem when we submit this as our current health insurance?

Remember that removal of conditions is not about fulfilling income requirements but about proving a bona fide marriage.

As you didn't file a tax return for 2020, send a letter explaining why -maybe include W2's to prove you did not earn minimum income-. Regarding healthcare, send any document that includes both your name and your spouse's name.

The USCIS only wants to see both your names on certain documents. There is no financial requirement that you have to meet. They don't care if your income is low or high. You're good as long as you send whatever you have with your guys' names 👍 gather as much evidence as you can. Good luck!

why would they require evidence of your citizenship for i-751? Did the letter specifically ask for it?

@LirikBlaidd87, I do not know why we included proof of US Citizenship, but we did. 

 

I-751 Joint Filing.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.
