Hi guys,

I have a question and hoping that you could give me answers or suggestions on what we can do.

We've submitted our packet AOS I-485, EAD I-765 and AP I-131 in February 3, 2021 and we received the receipts in March 22, 2021.  However, we received recently an RFIE for supporting tax documents since my tax return in 2019 that we submitted didn't reach the poverty guideline.  Also my wife applied for her ITIN last February 17, 2021 and she got her ITIN in April.  We then submitted our Federal tax return last April 30.  I have asked for my 2020 transcripts but when we received them it has no information which I believe they haven't gotten my tax paperwork yet since we applied it by mail. Anyway, we have a joint sponsor since my income in 2020 is not also enough.

Here is my question:

1. Since my income in 2020 didn't qualify, are we only submitting our Joint's sponsor's Form I-864 and her supporting tax documents? Or do I also have to sent out my 2020 tax documents?

Thank you very much for your help.

The main sponsor (spouse) must always send a 864 and send a tax return transcript even when they don't meet the threshold amount.

So you must submit your latest tax return/transcript with your 864, it doesn't matter your income.

I see. Initially I submitted my 2017-2019.  Would it be okay to resubmit it again since my 2020 transcript isn't yet available?

Thank you.

Thank you.

Submit a complete copy of the 2020 actual Federal, SIGNED tax return copy (all pages and schedules) in lieu of the transcript.
