Well that's interesting.

 

I will avoid filing a mandamus if this is the case.

 

Thank you for the valuable information. This was very helpful.

 

I will post again regarding the outcome of our case. I just hope that this information can help other couples who were stuck in the same position.

Good news! All is not lost. It looks like you are correct. The U.S. Embassy in Manila has taken the stance that they will consider extending validity for visas that expired while stuck in processing:

That is not new.  Consulates have always been able to extend the validity of expired petitions, at their discretion.

Yes, we are stuck in NVC. It was NVC that emailed me.

 

They have assured me that I and all the others stuck in NVC will be granted an extension and we will eventually be processed!

 

This is great news for a lot of people as far as I'm concerned. I would have liked the process to go faster, but this is the best result I can hope for, given the circumstances!

 

I just hope this good news can reassure some of you that are in a similar position. The K1 is still good! I'm not a lawyer, but if you have a K1 application in, I think it's best to just wait it out, even though you might be getting impatient.
