Hello,

My wife's child has his visa interview on May 24.  We have prepared notarized special power of attorney letters for his grandfather's accompaniment during the interview, and for me to go there and accompany him on his way to US since his mother does not have AP or greencard yet.  My wife and the father of her child were never married, but we were thinking that we need to get the child's father to grant me special power of attorney for me to be able to accompany the child.  Is this correct?   Also, do we need to get a letter from the child's father also that states that he is okay with his child coming to US?  

Any help is appreciated.  Thanks!

This needs to be moved to the Philippines regional forum otherwise you will get general answers that may not be applicable. 

 

An illegitimate child is under the legal control of the mother.  No parental consent from the father is required.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Thanks payxibka, that was helpful.  Even though she has full legal control over her child, is it enough for her alone to issue special power of attorney for me to accompany her child on the way to US?  I thought that could be an issue since instead of a parent accompanying the child, it is the step parent, so I didn't know if that would require both parents to give power of attorney.

As mentioned above, no SPA or any sort of consent from the father is necessary for your step-child to be able to travel to the US.

 

You might encounter an immigration officer at the airport who will ask for a DSWD clearance for the child.  Minor children traveling with an immigrant visa are exempted from needing the clearance.  In any case, the father's consent is still not needed to get a DSWD clearance for an illegitimate child.  More info here -- https://www.philippine-embassy.org.sg/the-philippines-2/dswd-travel-clearance-for-filipino-minors-2/

 

Sounds like you plan to travel to the Philippines to pick up your step-child.  Are you a dual PH-US citizen?  Or do you have an existing visa and exemption waiver?  If not, how will you board the plane to the PH?

1.) Wait for AP for mom to take of this. File for emergency AP or wait for AP to be approved

 

2.) Can't the child fly to USA alone?

 

3.) You are playing with fire trying to transport a minor back to USA that isn't your blood.  

 

Under Republic Act 7610 or the law on the special protection of children against abuse, exploitation, and discrimination, it is illegal for “any person who shall keep or have in his company a minor, 12 years or younger or who is 10 years or more his junior in any public or private place, hotel, motel, beer joint, discotheque, cabaret, pension house, sauna or massage parlor, beach and/or other tourist resort or similar place” unless there are family ties or some other legal bond or obligation involved.
