US Citizen living abroad and is looking to petition soon to be husband

Hello everyone, 

I am currently thinking of petitioning my soon to be husband. A little backstory first, I was born in the states and lived there for 13 years before my parents decided to move back to Guatemala. We've been living in Guatemala for 12 years now, and honestly I want to move back to the states, I have gone every year to visit my family in the US. Ok now to the actual info that matters, I have been dating my boyfriend for 9 years and we're both ready to get married in June (we have not lived together, I've been living with my parents) and want to move to the US. So I started researching the whole process of petitioning and all the fee's, I came across Direct Consular Filing under Exceptional Circumstances and would like to start the process. I have been applying to jobs to get the relocation letter and am waiting to get hired from one hopefully. I would deeply appreciate it if someone can give my a little guidance on how to this because I feel so lost. My questions are:

1. How do I start this process, do I have to go directly to the embassy of Guatemala or can I do it online?

2. What's the time frame of relocation notice? can it be implying me to leave to work in 2,3,4 months?

3. I will be having a joint sponsor since I have not lived in the states for 12 years, Can my joint sponsor be my brother? he has a stable job and is earning more than the total year earnings.

4. My brother can hire me and give me the relocation notice, Would this be a problem?

5. If the embassy approves, how long would it be expected for my boyfriend to get his visa/green card/SSN?

6.  What kind of documents would they want me to show to see if our relationship is real?

7. Do you think DCF-EC is the way to go?

Would be very thankful if someone can help me answer these questions :) also can I start the process as soon as next month or July since we are getting married in June?

1.  Each consulate will do it differently.   You need to email them and ask how they want it done.  Some consulates will simply not do it for any reason.   

2.  The quicker the better 

3.  Should be fine

4. Maybe,  maybe not

5.  TBD

6.  Besides the obvious marriage certificate,  you will need to decide how to craft your narrative.   

7.  If you can get them to do it

thank you for your response, I also forgot to add that since i have been living in Guatemala since i was 13 years old ( now 24) i have only done 2020's taxes. will this affect me in anyway regarding the affidavit of support?

what is TBD? sorry i am new to this :)

Only if you were required to file and didn't.   If you didn't meet the minimum,  then you simply attach an explanation as to why you weren't required.

How would I know if I was required to file? Sorry for so many questions I feel lost I don’t really know anything about taxes

It's based on your amount of worldwide income.  You said you filed in 2020,  why?  What changed?

On your US Passport is a reminder to file US Taxes.  If you didn't meet the minimum that isn't an issue for the petition.  But you do need to meet the sponsorship requirements by the time of the interview or have a sponsor.

 

You need to have the reason for extenuating circumstances such as a US job that is starting soon or an Univeristy program.   Just wanting to move back to the US isn't extenuating circumstances.

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

DCF with exceptional circumstance?  My call:  Not a prayer

In your case?  I’d advise you to get to the US and establish some ties.

Then get married and petition.

I worked for two weeks and then the pandemic hit and left me unemployed

Yes that’s why I want to go the DCF-EC route, I’ve been applying to get a job so I can relocate with my soon to be husband and show proof of job notice to the embassy. 
Also I would have a joint sponsor which would be my brother, do you think this would be a problem?
