Hello everyone

Have a question about my stepdaughter citizenship path requirements.

My wife will have her citizenship interview next month, as soon as she gets her naturalization certificate we want to get my stepdaughter her passport as well ( she is 8 years old)

I have a question in regards to the DS-11 application, it says for minors under 16 years old both parents need to be present. This will be a problem since her biological father resides overseas and does not have a visa to travel to the USA.

Will we have to mail him form DS-3053 or will form DS-5525 will suffice in this case? I do not think they will consider me her legal guardian.

Does your wife have sole legal authority?

I agree, if your wife knows how to contact him, that seems your only route.

You can probably use scanned/emailed copies as long as the notary information is proper.

I do not know anything about this topic BUT why mail him the form? I looked at the form and it's 2 mins work. Just fill it out for him and email it to him. Tell him to go to Consulate or wherever to get it notarized and scan the copy back to you. Zero $$ spent.

Regardless, since the kid is in the US with you and you wife, doesn't that mean that your wife has sole custody? Or else she couldn't have left Venezuela. If that is the case, I think you can just get the PP since she has sole custody.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

I will need to find out if scanned copy will be accepted. About the sole custody, Venezuela is a very complicated country, he had to sign a document authorizing the girl to travel with her mom, but they did not have a formal document for permanent travel ( like a K2 visa) they did not even know about a K2 visa, she had to go to the airport and talk to an immigration officer so he could call back the lady from the office who issues the travel permit to explain to her the procedure. I will need to check what does the form says, but i doubt it states anything about permanent travel to the USA. Of course he was aware and gave his permission to bring the girl to USA. Either way i do not think it will be such a hassle since we keep in touch with him.
