What if I-94 expires ????

Can some one tell me what happens if my Fiance's I-94 expires while waiting for the AOS. I am preparing her AOS packet now for shipment, and I want to make sure we are not penalized when her I-94 expires b4 we receive approval.

You won't be penalized, don't worry. You are not considered out of status if you have an AOS application pending (as long as you have married within the 90 day period). If you're worried, your wife can carry around a copy of your NOA once you receive it.

don't worry. it's not a problem. all K-1 I-94 expire before AOS approval since they are 90 days. even if you sumbit the application after the I-94 expires, it will not be a problem. best of luck with the AOS

If you're filing AOS it shouldn't be a problem as long as you followed the marriage within 90 days and are filing ASAP afterwards. My I94 expired without any penalty at the interview.
