Applying for citizenship with a 90s marijuana charge

I was asked by a female my thoughts on applying now for citizenship, she hold a post high up in a corporate job own her home & vehicle, but was arrested in Ct early 90s for less than 5 lbs weed.Never been arrested before or since,I think she was fined,she now lives in another state have had 3 traffick stops, only an outstanding ticket from back then showed up...she paid it, but she does no international travel,she have also renewed her GC more than once.

I recommended atty Brown to take her thru the citizenship process..thoughts or exp on this?

An arrest will affect citizenship process.

state dependent and we don't know his state

 

What Is Drug Trafficking? In Tennessee, possession of more than one-half ounce of marijuana is considered drug trafficking, even if the suspect had no intention to distribute the drug.

Ok ....hey Boier long time, I have been a long time member, use to answer many worried ppl but stayed positive...look at old threads. I said less than 5 lbs as her only question was can sne apply, I believe in being factual but not a spirit pooper so

I recommended to her atty.....Iguy...I agree with your statement.She never charged with any distribution & it was less than number I threw out it was ozs I hardly visit here as many ppl cáme on negative & mean, due to possible expungements I threw tne question out...thx guys

To be fair theres a huge difference between 5oz and 5lbs. 

 

1oz is like a coconut. 1lb is a watermelon. 

 

5oz is still a significant amount. Are you sure it was oz and not grams? Immigration policy allows for 30 grams or less. 1oz = 28 grams. 

 

1 gram is like a hazelnut. 

 

It seems more likely she had 5 grams (5 hazelnuts) on her person in a sandwich sized type bag rather then 5oz (5 coconuts) as the latter most likely would have been a more serious charge. If so 5 grams wont be an issue. 

 

She should gather whatever documentation she has to show to the attny, the exact quantity matters. Hopefully it was 5 grams. If it was in fact 5oz then she should not file at this time and hope the US changes its overall marijuana policies so it will no longer be an issue for her approval.

That does not prove innocence, maybe at the Federal level and expungement would help.

Other than the application fee, does she have to lose by applying for naturalization? I would think that that the worst thing that can happen is that she is denied. If there was an issue then, I would think that she would have been deported.
