Refusal (221G) - Proof of relationship and Joint sponsor (merged)

Hi, We got 221G.

 

It will be a very long post because I feel devastated and I dont know where I can ask for advice and too many things going on in my mind.

 

Petitioner born in 1951, NZ citizen, LPR. He is retired.

Benefactor born in 1990, Indonesian citizen.

 

We first met in New Zealand December 2016,

We live together between October 2017-January 2019

We are married in August 2018

 

Petitioner left NZ for good since January 2019.

Benefactor stay in NZ till now because work visa in NZ.

 

One of the reason why we are separated is because a very high living cost in New Zealand. And we don't want to keep renting and losing money while Petitioner has a condo in America.

And also because Petitioner wants to focus getting citizenship, and he has been outside America too long to live with me.

 

The last time we see each other was in Bali November 2019, for 3 weeks.

 

F2A case, DQ November 2020.

Got interviewed recently.

 

We got 221G, it was very shocking for us because we have been separated very long and because COVID we cannot take holiday together. (NZ has a very strict quarantine rules)

 

To keep it short, there are 2 things that is very hard to fulfill.

 

1. Joint sponsor. Petitioner does not have other family member in America.

We are shocked they still need Joint sponsor although we have a very huge assets. It is above the poverty threshold x5
We don't know if we can get somebody to help us.

 

2. They need more proof of relationship.

We don't know what should we submit anymore.

 

The last time we visit each other was in Bali for 3 weeks in 2019, However the consular did not ask anything.

 

We contact each other daily using watsapp, and sending cards and gift.

 

However, we are not sure whether it is enough evidence for proof of relationship. because we have not been living together too long.

 

what should we do to proof that our relationship is genuine?

 

Is there advice to prove that our relationship is genuine?

Yes, we have huge age difference. and We have genuine relationship.

 

While it is sad, it seems we are going to live in Bali if we don't get new evidence for 221G
How long is 221G? is this gonna be forever?

Hi, we got 221G.

I, the applicant, was panicked.
Now, it seems I feel better and did my research.

I understand that it is a white 221G refusal, so we still have chance.

We are asked 2 additional documents
A. Joint sponsor.
This is the most tricky one. Yet, I can only hope that my husband find somebody to help us.

B. Proof of relationship.
I was not my best when doing interview. I was nervous and not well rested.

I remember our timeline from December 2016, but I forgot to mention our holiday together in Bali November 2019.
I have Petitioner's hotel booking, Aplicant's flight tickets, and photos of us together in Bali.

However, I only give the staff our photos together in Bali and our watsapp chat and call log.
I forgot to give the staff the hotel receipts and flight tickets details.

 

I was very shocked that I got refusal that I forgot to ask what kind of other evidence to support proof of relationship.

 

I have gather the new evidence for proof of relationship.
I have
1. Hotel receipt in bali

2. Applicant (me) flight ticket to bali.

3. All cards that we send to each other, some has date... some does not have date.

4. Photo of us in Bali.

5. The friend statement of our relationship. However, it does not change much from our submission in I-130

6. 30 pages of our watsapp chat and 10 pages of our watsapp call log.

 

Is this enough evidence?
I was very shocked and not able to think much of it.

 

Then, next question is how to submit 221(g) form?

We checked the website https://www.ustraveldocs.com/nz/nz-iv-documentsubmissioninfo.asp#:~:text=Go to the nearest New,your 221(g) letter.
However, I cannot choose submit documents.

And in the CEAC online,
The AoS documents has become "INCOMPLETE"

We have no idea how to proceed from here.

you have 39 years age difference so this is the big issue

Did you submit the marriage license?

did you show joint residence in NZ when you lived together?

any joint bank accounts there?

any joint bills?

 

and yes,  if they ask for joint sponsor ,  you will need one

Yes, we submit marriage license.

a1.We have joint residence, we can prove it using joint bank account and mail history.
a2. However, the thing that I mentioned in #a1, is only evidence during October 2017- January 2019

 

We are planning for holiday in 2020, but it was cancelled because COVID.

Though normally the most important, the petitioner's income/assets is just one of the factors considered by the consul officer in assessing the risk of the beneficiary becoming a public charge.  The CO must consider the totality of circumstances of the case, including the petitioner's age, estimated cost of living at US address, etc.  Now that the CO has decided that a joint sponsor is required for your case, I'm not confident that there's a way for you to proceed without one.

You mentioned that you lived together between Oct 2017 to Jan 2019.  That's more time spent together than most couples going through the visa process probably have.  What evidence from that time did you submit?

Focus on submitting what's required as soon as possible.  Then follow up with the consulate regularly if you don't get timely feedback.  Not much else you can do beyond that.

that joint history will help / that is proof you commingled finances when together 

still he needs joint sponsor as they ask for /or see a lawyer to get them to accept his SSA and any retirement as his annual salary

many do not pay taxes on SSA so it does not show on IRS as taxable income and immigration ignores that part

·         Petitioner’s four (4) flight ticket to New Zealand to visit beneficiary;

·         Joint tenancy agreement when Petitioner visiting spouse in New Zealand;

·         New Zealand Joint account bank statement of Petitioner and Beneficiary;

·         Two copy of a signed affidavit of Bona fide marriage from our friend

·         Marriage vows and Marriage ceremony pamphlet;

·         Watsapp Chat History of Petitioner and Beneficiary;

 

Focus on submitting what's required as soon as possible.  Then follow up with the consulate regularly if you don't get timely feedback.  Not much else you can do beyond that.


Problem is, I dont know how to submit them. The website did not work.

Not sure what you mean by that.  The website says: "All documents and information requested in a 221(g) letter should be submitted at the nearest New Zealand Post document collection office".  Contact the consulate to ask about the list of document collection offices near you.

Since when is he an LPR? How did he get his green card? Was he in the divorce process when you met him?

I really don't know if he stayed more than 1 year out of the US and because he is retired (+the age gap) could affect the case too. 

Does he have kids? Any dependents?

I dont remember, it was more than 20 years ago.
He got his green card by employment.

No, he already divorced when he see me.

He stayed ouside of USA like 6 month + 3 month + 2 months


Yes, he had 3 kids, already adults.
No dependents

Thanks for answer. 

You told in other post that he currently receives $1300 aprox of Social Security and have assets.  

I don't know where he lives but 1300 per month is really low.  

His assets are good for the visa but considering that he is an retired man this is a normal number for himself.

I really think in your case the CO is correct in ask for an co-sponsor because you are really young and will need a lot of support here.

Are you in his health insurance? Is a good evidence too.

That’s where we’re retiring to LOL.  I’m thinking what’s wrong with that

 

With that said - 

 

Age difference

Distance

Income / support affidavit

 

You have several red flags.  He is back in the US you say?  
 

The evidence you gathered is pretty good. Huge assets in Bali may not be huge assets in the US.  They want cash, liquid assets and you have to overcome 3x not 5x the difference between required and actual income.

What were your, and his, plans for health insurance?  That helps.

It's always the safest bet to act upon what ever is required on that 221G you provide it as soon as possible in order for your case to be concluded. And like others rightly mentioned and you know for your self your case does has some red flags but if like you say you have solid evidence for proving your relationship is a genuine one then you should try finding a joint sponsor. You also mentioned that the petitioner has 3 adult kids. Are they in USA if so how likely is the possibility of one of them becoming a join sponsor if they all are financially stable?
