RFE out of wedlock child

Hello,

 

My sister files for I730 to petition for her daughter. She was born out of wedlock but she has a birth certificate as the mother. The USCIS is asking for bona fide evidence. Is the mother required to proof bona fide relationship? I thought that was only for the father?

yes,  she would have to prove this is her child 

anytime immigration says they want a document or proof,  it must be done or the case is in limbo

and a mother would have to prove she is actually the mother

her mother is sponsoring the child to bring her to the US. so yes they are asking for the correct documents 

duh

This circumstance is covered right there in the letter -“....between the child and the natural mother...”. Has she spent a lot of time apart from the child since birth? Was the birth certificate issued more than a year after birth? Either of these circumstances can lead to such an RFE

SHe has to show proof that although she was living in the US and someone else was caring for the child she still performed duties as the parent especially proving financial responsibilities.  

Phase I - IV - Completed the Immigration Journey
