I-864 Tax records missing

Hello everyone,

first of all thanks for all the help so far. This forum is incredible helpful.

We got our I-130 approved last week, and honestly I did not expect it to go that fast at all (50 days). This is amazing news, but we have a problem with not having my husband's 2020 tax return (petitioner) yet. He applied for an ITIN for me in order to do his taxes in February. After 3 months of waiting we got the answer that they can't process the case, because he was supposed to file his taxes with the application for an ITIN, which wasn't clear to him. So now we need to wait another  10 weeks to get his tax return papers for 2020. We were thinking of several options:

1. filing the I-864 without 2020 tax return, but with W2 and explanation why he did not include the tax return paper
2. asking his parents to be joined sponsors
3. waiting until he gets the tax return (least favorable of course)

Any suggestions on what would be the best way to proceed?

You don't necessarily need a transcript. I would file the I-864 with a copy of his 2020 tax return (and W2, etc)...which you should have now.  I would not file the I-864 without a copy of either the 2020 tax return or a copy of the transcript.

Right, a copy of the complete tax return with W2s etc. will do nicely.
