Hello, 

 

Here is our situation : I am GC holder, I am married to a Canadian (he is in the US on B2) and we have a baby USC. 
 

We are filling out the forms for AOS. In for form 130A. There are asking for the last 5 years addresses. As we are planning to send AOS package before 90 days, do we have to put his starting date for the current address on the day he arrives in the US or We should put the starting date for the day he change his intentions to do an AOS
 

I am a bit confused. 
 

anyone can help please?

Doesnt much matter but changed his intentions as he was just a visitor prior.

The address when he “changed his mind” if it makes you feel better. Of course it will be obvious to the interviewing officer that he has been at this address since he entered the US, seeing as you are married.

How does that work?

 

For example, his address from 5/1/2021 is 123 ABC Street, Anytown, State, Zip, USA.

 

His address from (let's say he entered on Mar 1) 3/1/2021 to 5/1/2021 is also 

123 ABC Street, Anytown, State, Zip, USA.  The same address.

 

You should not list his CA address from Mar 1, 2021 to 5/1/2021.  USCIS will have his I-94 information and will know he arrived in the US on Mar 1.

 

Might as well list the start date as the actual day he started living there.

Sorry : I did not understand. 
 

Let’s say: he entered on april 1st 2021. I will send the AOS on the 2 june 2021. 
He changed his mind on the 31st may 2021 and decided to do AOS.   So He ends his lease on the 31st may in Canada but he was already in the US from 1st april 2021. 
 

then what should I put in the form 130A. ? Please check the joint file to understand the addresses numbers. 
 

address 1 : current US address , DATE FROM : 1 june 2021 to PRESENT 

 

address 2 : his canadian address , DATE FROM : 01/01/2010 to 05/31/2021? 
 

address 3 : same as address 2. 
 

OR

 

address 1 : US current address, DATE FROM 1 april 2021 to present.  

 

 

address 2 : his canadian address, DATE FROM : 01/01/2010 to 03/31/2021 

 

address 3: same as address 2. 
 

which option is Right?

He left everything at his old apartment and then cancelled the lease? Really? What’s happened to all his stuff? Did he have a job there? What are his employment dates going to say?

 

anyway it doesn’t really make a big difference under the circumstances. Fill in what you believe to be correct and he can explain it at the interview.

Re self-employed, you realize he can’t be working from here, right?
