What next after your I-485 is Denied based on K1 marriage

Yes you are out of status, being married grants no direct immigration benefits, you need to apply to adjust status which will give you temporary right to remain in the US while the AOS application is pending.

So I just received the hard copies of the Denial Notices , plus my Children.😭😭😭😭

with instructions to return all work authorization documents to the nearest USCIS office,

 

I am halfway not breathing the stress is killing me.

Also my husband got a copy of correspondence 

that his request to withdraw Affidavit of support was honored by USCIS. 

 

I need help here again ,

1)How do I return the EADs without fear ?

2)The main reason of denial is because my husband withdrawal affidavit and they state decision is final 😣😣😩

3)Will this affect our newly re applied AOS petition???

 

Do they really indicate you can re apply ??

Wait until you get the receipt notices for the newly-filed I-485 packages for you and your children.  Until then, keep a low profile.

You may get questions about it at your AOS interview.  I recommend you retain all correspondence with the lawyer showing that your husband changed his mind about sending the I-864 withdrawal notification.  Also, documentation that you and your husband are undergoing counseling to resolve whatever marital issues led to his initial decision to withdraw support.  Continue to collect evidence of shared finances and bona fide relationship, and bring them all to your interview.
