What next after your I-485 is Denied based on K1 marriage

I don’t understand your point, this is seriously immigration issue I am just looking for genuine help not to be stoned 😞😞😒😒

So you’re saying the lawyer (who was hired, AS A LAWYER) did their job (when asked by the client to withdraw) and now somehow they are unprofessional for doing their job and asking to be paid?

 

Honestly, if a “slight” misunderstanding would cause this, maybe the couple should try to talk things out and see if they need a professional’s help (with counseling or even you mentioned his “mental state” wasn’t stable) because marriage and this whole immigration thing shouldn’t be taken lightly. I’m pretty sure the US Immigration wouldn’t take it lightly as well. 

Imagine if the petitioner’s friends would tell him to divorce the beneficiary. What would he do then?



EDIT; like people have said, RE-FILE before it gets too late. Let the petitioner/beneficiary make an account and ask for advice themselves. 

TL;DR: RE-APPLY AND SEND DOCS AGAIN.

he went again back and asked the lawyer to NOT TO PROCEED WITH IT  ( Same week) meaning sending out the withdrawal letters.

At that point the lawyer was paid all dues diligently . I have proofs, 3 weeks letter the secretary sends out the withdrawal without consent or sending email to Petitioner prior or maybe Petitioner should have consistently followed up 

Anyway our case was scheduled for interview and actively up to date.

3 Days ago all changed case denied !!

And no one could understand that only for Petitioner to call that office and confirm they send withdrawal last week 😖😖 .Yes the Lawyer was aware of NOT sending it out may be his office staff wasn’t.

Something is not adding up.  
 

I was the K-1 petitioner.  My wife was the K-1 beneficiary. She entered the USA on her K-1 visa 

 

My understanding is the lawyer we hired to handled the I-485 was my wife’s (the beneficiary) lawyer.  Not my lawyer.  
 

How is it the beneficiary’s

lawyer withdrew the beneficiary’s I-485 petition?

lawyer withdrew the beneficiary’s I-485 petition?

The petitioner withdrew his I-864 Affidavit of Support.

I wonder how this kind of withdrawal will look during the interview. It seems like you guys have a roller coaster relationship. Glad you’re going through therapy.

My application from K1, K2 was denied and I reapplied. When I got denied, I had asked here like you did too. Everyone told me that just reapply with the fee or you will get deported some day but not soon as long as you are in the US legally. Worse people would get earlier deported. 
I actually knew my denial 6months after the decision, so you can still reapply and don’t be afraid to get deported. You would just need to know why you got denied.

Have reapplied again with my K2s and send it out a day ago,

just praying all be well.

It was before pandemic, I reapplied in October 2019, then we were supposed to have an interview in April 2020 but it was canceled due to the COVID. Honestly I have changed my application for VAWA which is for victims of violence, so now my  I-485 was held, but I’m sure the process is way faster than even before pandemic.
 

I hope yours is going well!!

Praying for you and your K2s , May you have a wonderful ending To swift interview.

Mine we refilled again and my husband still the petitioner, only that this time had to hire an immigration lawyer to do it , so costly but it’s Alright.

So long as we are a team we can overcome 👍🏼💪💪💪

Yes, you dont need to be afraid of getting deported, just be aware its a very real potential outcome while you remain in the US out of status no matter if some other people have managed to get away it before. Personally I wouldnt want that hanging over my head.

Yes you are out of status, being married grants no direct immigration benefits, you need to apply to adjust status (which i see you have) which will give you temporary right to remain in the US while the AOS application is pending.
