So what should one do?

leave the USA??

As others have said, your friend should refile the AoS forms IMMEDIATELY. Tell him to make his own account here so we can directly give him advice and to stop listening to people who have zero knowledge about this topic.

Maybe you missed my post above.

Thank you 🙏 are re refilling and hopefully send it out in next days.

As other have advised, the entire AOS process has to be refiled.

How was the lawyer unprofessional?  His client instructed him to withdraw the case, and he did as he was instructed.

True but the lawyer failed to understand the client wasn’t mentally stable 🤷🏽‍♀️ And week letter he went and canceled the request to same lawyer .

however 3 weeks later the lawyer still send out the withdrawal to USCiS 🧐 and now demands to be paid ???

I don’t understand your point, this is seriously immigration issue I am just looking for genuine help not to be stoned 😞😞😒😒

How are you involved in this case?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

May be am the beneficiary 😞😔😭😭😭

Thanks.  It helps when we know we are answering questions from the people actually involved.  To recap, just refile everything again....including the EAD and I-131 since the basis for those was the now-denied I-485.  Personally, I would pay the attorney for work done....then I would refile myself using the guides here on VJ.  Good luck.

Thank you so much for understanding and advice,

we have hired an attorney to Refile it all for us.

i-485, EAD and wasn’t sure to do I-131 again, now I do.

Is it ok if my husband included a statement since he’s the Petitioner again?

2) Question

is it true refilled application takes a longer period to process compared to first time.

I don't think a statement from your husband will make any difference.  I would ask the new attorney.  I see no reason to think a re-filed I-485 would take longer.

Alright,

they never requested but was interested on what statement was used to send the withdrawal,

which they advised will be necessary to proof more on our marriage etc a head of GC interview.

Though also said if he could write a brief statement it’s no arm to attach in the new applications.

Thanking you for the information shared here.
