What next after your I-485 is Denied based on K1 marriage

Timeline

😓 unfortunately due to slight misunderstanding the petitioner withdrawal affidavit of support without informing his wife and later the denial Notice comes up !Remember they not divorced yet and really a beautiful family have built a lot together.Was done out of anger reactions even after canceling it still the so consulted un- professional lawyer sends it out to the USCiS for her greed of money.

At that period the K1& K2s was scheduled for GC interview but all now is Denied.

 

Do we have anyone in similar situations or what’s the guarantee way to manage this heartbreaking situation???

Actually he’s very sad and 200% cooperative it was a ill advise he got from friends.

he loves his wife and family.

and after one day argument he approached a friend who ill advised him to withdraw affidavit of support.

Which he later cancelled the application but unfortunately the lawyer filled it anyway .

 

So what can this family do????

and ready to fight this battle

If they are still married, they can just file for AOS again.

what about work because the lady and K2 already had EADS and SSN , meaning everything was smooth with USCIS.

should they stop?!

As others have said re-file.  I will add that the until re-filed the alien spouse is subject to removal and/or a ban.  The alien spouse should steer clear of situations that might directly or indirectly result in an encounter with a DHS law enforcer.  This includes and is not limited to airports, even for doesntic flights, and internal CBP check points.

Refile the complete  I-485 package ASAP , since a denial has been issued by USCIS (for the first package).

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Refile for another EAD........
