Timeline

Hello! We just received our NOA2 earlier this week so I was being proactive in looking at our next step. I was looking about on the state.gov for some information for the Affidavit of Support (I-134) and I saw this:

Do the Same Income Requirements Apply to Form I-134 as Apply to Form I-864?

No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.

 

I meet the current 100% but not the 125% and I have a sizable amount in savings (almost 15,000). I am about $2,000 off on my current 2020 taxes for 125%. My mother has already stated she would be willing to joint sponsor with me, but I was just wondering if I could do by myself or should I just be safe and have a joint sponsor?

You can always try yourself and hold the co sponsor information in your back pocket.

Thanks! I think I will try by myself and just have my mom's information for my fiance if they need it.

Timeline

K1 is handled differently than CR1 for documents to the embassy.  For CR1, you would need to upload copies of all documents to NVC, and the embassy would have access to these.  Then the beneficiary would bring originals to the interview (except I-864).  

 

For K1, there is no pre-submitting of documents to the embassy.  They give you a checklist of what to bring (Packet 3), and the beneficiary brings those to the interview.  The day of the interview is when the CO at the embassy has a first look at those documents.

 

DS-160 is different - that form is completed online before the interview and therefore the embassy has access to that for review.
